Murder of Governor in Pakistan Darkens ‘Blasphemy’ Case


Assassination called a blow to prospects of justice for Christian mother on death row.

LAHORE, Pakistan, January 5 (CDN) — The case of Asia Noreen, the first Christian woman sentenced to death in Pakistan on blasphemy charges, suffered a major setback when her most vocal supporter, the governor of Punjab Province, was gunned down by one of his police bodyguards yesterday (Jan. 4) in Islamabad.

The lives of Noreen and Gov. Salman Taseer were at risk since the day he, his wife and daughter visited her in the Sheikhupura District Jail on Nov. 22, after news of her conviction appeared in the media.

Taseer had openly criticized the blasphemy statutes and vowed to try to repeal the “black laws” in parliament. He also promised Noreen (also called Asia Bibi) that he would recommend a presidential pardon for her.

The governor’s assurance and his support for Noreen gave new hope to the impoverished mother of two children and step-mother to three others – and drew violent condemnation from Islamist forces, sparking countrywide protests.

“The governor’s visit gave us hope that all was not lost,” Sohail Johnson of Sharing Life Ministries Pakistan, which has pursued Noreen’s case from the onset, told Compass. “We believed that God had sent the governor to help us … his words of support boosted Noreen’s morale, and she was actually quite optimistic about the outcome of her appeal in the high court.”

He said the murder of Taseer in broad daylight had shocked all those opposing the blasphemy laws, and that “there is little hope of these laws ever being repealed.”

Johnson confirmed that Noreen’s life was at high risk ever since the governor had highlighted her case.

“The local Islamist forces believed that President [Asif Ali] Zardari would pardon Noreen on Taseer’s recommendation, and this was unacceptable to them,” said Johnson, confirming that intelligence agencies had determined that Islamists had plotted to kill Noreen inside jail to make an example of her. “Noreen was earlier allowed two hours in the morning and two in the evening to go outside her cell to relax. After the intelligence information, the jail authorities restricted her movement, and now she is kept in the cell at all times. A security guard has also been deployed with her.”

He added that news of the assassination of the governor would surely panic the Christian woman.

Johnson said Noreen’s appeal of her conviction had yet to be taken up for hearing by the Lahore High Court, but that the murder would definitely affect the course of justice. “The governor’s brutal murder has diminished our hopes for justice for Noreen,” he said.

Her family, he said, has been in hiding since Islamist parties started protests in favor of the blasphemy laws.

“Even I am keeping a low profile these days,” Johnson said.

Taseer and Noreen were declared “Wajibul Qatil” (liable to be killed) by radical Islamic clerics. A cleric in Peshawar and a local politician in Multan offered a combined sum of 50 million rupees (US$579,300) for anyone who killed Taseer and Noreen.

Protests, shut-down strikes and general uproar pressured Pakistan’s federal government to announce that the blasphemy laws would not be repealed.

Taseer, however, continued to publicly vent his opposition – even using Twitter – to the blasphemy laws, which effectively mandate death for anyone convicted of insulting Muhammad, the prophet of Islam. Although courts typically overturn convictions, and no executions have been carried out, rights activists say the laws are used to settle rivalries and persecute religious minorities.

On Friday (Dec. 31), Taseer had tweeted “I was under huge pressure 2 cow down b4 rightest pressure on blasphemy. Refused. Even if I’m the last man standing.”

The assassination is significant not simply because of the person targeted and the reason behind it, but because of the broader societal implications.

“[It points to] the presence of radical elements inside the Pakistani state apparatus,” said columnist Cyril Almeida.

He said that the fact that Taseer’s own bodyguard shot him is not just worrying because it indicates a failure of the vetting process but because it points to “the extent to which this poison has affected the Pakistani state. The investment in jihad has come home to roost.”

In the hours immediately following the killing, television anchors hosted several shows in which guests, while stopping short of openly supporting the murder of Taseer, did speak out in support of killing those deemed to have blasphemed. Some Pakistanis have reported that they received text messages on their mobile phones praising the assassination.

Pakistan Interior Minister Rehman Malik has said the guard, Malik Mumtaz Hussein Qadri, told police that he killed Taseer because of the governor’s opposition to Pakistan’s blasphemy laws. Qadri had escorted the governor from Rawalpindi to Islamabad on Tuesday (Jan. 4).

A 26-year-old policeman from Barakhao on the outskirts of Islamabad, Qadri had reportedly transferred to the Elite Force after commando training in 2008. Thus far, he has not been identified as a member of any violent Muslim extremist groups but is considered devout in his faith.

Noreen was convicted under Section 295-C of the defamation statutes for alleged derogatory comments about Muhammad, which is punishable by death, though life imprisonment is also possible. Section 295-B makes willful desecration of the Quran or a use of its extract in a derogatory manner punishable with life imprisonment. Section 295-A of the defamation law prohibits injuring or defiling places of worship and “acts intended to outrage religious feelings of any class of citizens.” It is punishable by life imprisonment, which in Pakistan is 25 years.

Suspected Islamists Shoot Five Christians to Death in Pakistan


Muslim extremist groups had threatened church for two years.

SUKKUR, Pakistan, July 29 (CDN) — A dozen masked men shot five Christians to death as they came out of their church building here on July 15, two months after a banned Islamic extremist group sent church leaders a threatening letter, relatives said.

Pastor Aaron John and church members Rohail Bhatti, Salman John, Abid Gill and Shamin Mall of Full Gospel Church were leaving the church building after meeting to discuss security in light of the threats they had received, said the pastor’s son, Shahid John.

“As we came out of the church, a group of a dozen armed gunmen came and opened fire at us,” said Shahid John, who survived a bullet in his arm. “Fear struck the area. The police arrived 45 minutes after the incident, and we waited for over 45 minutes for the ambulance to arrive.”

Besides Shahid John, five others were wounded in the attack.

In May church leaders received a letter from Islamic extremist group Sip-e-Sahaba (formerly Sipah-e-Sahaba until it was banned) warning the Christians to leave the area, said Kiran Rohail, wife of the slain Rohail Bhatti.

“It said to vacate the land, Christians are not welcomed here, they are polluting our land,” Kiran Rohail said.

The Sip-e-Sahaba and Sunni Tehrik extremist groups are both linked with an area madrassa (Islamic school) whose students had been threatening the church since 2008, Christian sources said.

“In 2008 a group of Muslim students started making threats for the church to vacate the land, as there are only 55 Christian families living in the area,” said the pastor’s widow, Naila John, who also lost her son Salman John in the attack.

The masked gunmen of July 15 had young physiques like those of students, Christian sources said, and their manner of attack indicated they were trained extremists.

The madrassa students that have threatened the church since 2008 belong to the Sunni Tehrik extremist group, the sources said.

Pastor John and Bhatti had reported the threats of the past two years to police, but officers at the local station did not take them seriously, said Naila John.

When they received the threatening letter in May, Pastor John, his son Salman, Bhatti, Gill, Mall and another member of the church, Arif Gill, went to the police station to register a First Information Report (FIR), according to Shahid John.

“Police just took the application but didn’t register the FIR,” he said. “The station house officer just provided two police constables for security.”

On the evening of July 15, the pastor called a meeting to discuss needed security measures, his widow Naila John said. The meeting ended around 7:30 p.m., when they left the building and were sprayed with gunfire.

“No FIR has been registered due to the pressure from the local Islamic groups,” said Kiran Rohail, referring to Sunni Tehrik, Sip-e-Sahaba and the local mosque. “The police came and took our statements, but they didn’t show up again.”

An independent government source confirmed the shooting deaths of the Christians, adding that local Islamist pressure had prevented media from reporting on it.

The church began in 1988, and Pastor John had been leading it since 2001.

Sukkur, in southwest Pakistan’s Sindh Province, has been the site of previous violence against Christians. Last June or July, area Christians said, students from the local madrassa beat Pastor Adnan John of Multan, severely injuring him, after they saw him walking in front of the mosque wearing a cross and holding a Bible. In another instance, the Muslim students prevented Christian students from holding a Christmas program at a park.

In 2006, some 500 Muslims burned down two churches in Sukkur and a convent school on Feb. 19, reportedly over rumors that a Christian threw a copy of the Quran into a trash can. A crowd wielding gasoline bombs torched St. Mary’s Catholic Church and St. Savior’s Church of Pakistan after media and government sources floated the rumor, but local sources said the violence occurred after a Muslim was arrested for burning pages of the Quran and trying to frame his Christian father-in-law, Saleem Gill, with the deed.

After torching the inside of St. Savior’s, the mob turned on Pastor Ilyas Saeed Masih’s home, then went five minutes away to destroy the 120-year-old St. Mary’s edifice.

PAKISTAN: CHARGES FILED AGAINST KIDNAPPERS OF YOUNG SISTERS


Police ignore arrest order, but lawyers hopeful 13-year-old can be returned to parents.

ISTANBUL, February 26 (Compass Direct News) – After months of legal deadlock, lawyers in Pakistan said they have new hope they can restore to her family a 13-year-old Christian girl who was kidnapped and forced to marry a Muslim.

Saba Masih might be returned to her family, the lawyers said, if they can legally maneuver around Pakistani policemen who have stonewalled their attempts to pursue a kidnapping case against the captors. On Saturday (Feb. 21) a Pakistani judge charged the suspects with kidnapping for the first time in the seven-month legal ordeal.

“The judiciary is one thing, the police are another,” said Arfan Goshe, a lawyer who has taken on the custody case. “I will prove [the three accused men] kidnapped Saba so the judiciary will force the police to arrest them.”

On Saturday (Feb. 21), Judge Mohammed Ilyas issued a First Instance Report (FIR) at a subordinate court in the Punjabi village of Chawk Munda against Amjad Ali, Muhammad Ashraf and Muhammed Arif Bajwa on charges of kidnapping, trespassing, and threatening the Masih family.

Attorney Goshe, a Muslim, said the three kidnappers trespassed onto the property of Yunus Masih, the father of Saba, and threatened to kill his family and burn down his house in late December.

The decision to file kidnapping charges marks a major shift of momentum in the case. In previous hearings judges have nearly always sided with the kidnappers – based on either dubious evidence or threats from local Islamists – in the Muslims’ legal battle to retain custody of Saba and her 10-year-old sister Aneela. A court ruled the younger daughter could return to her family last September.

The two girls were kidnapped in June 2008 while traveling to visit their uncle in Sarwar Shaheed, northwest of Multan. Saba was married to Ali the next day. Bajwa and Ali registered a case with police on June 28 for custody of the girls based on their alleged conversion to Islam. The court granted them custody in July.

At nearly all the hearings, Muslim groups protested outside the courtroom against lawyers attempting to return Saba to her Christian parents. A traditional interpretation of Islamic law (sharia) does not allow non-Muslim parents to have custody of Muslim children.

In spite of the judge’s decision to begin procedures for kidnapping charges, Chawk Munda police have not followed through with the FIR by arresting the three Muslims. Today the judge contacted the local police station and ordered officers to register the kidnapping case against the three men, Goshe told Compass. He said he hopes police will file the FIR within the next few days.

“The police are favoring the accused party at this time,” he said. “Everybody knows [Saba] was abducted, and that the culprits are trying to threaten minorities everywhere.”

But others are less optimistic the kidnappers will be arrested. Khalid Raheel, Saba’s uncle, said he believes he may have to bribe the police. They would likely demand around 20,000 Pakistani rupees (US$250), he said.

Uncooperative police had also blocked the legal team’s efforts to register charges before Saturday’s ruling. As a result, the Christian family’s lawyers filed a private complaint to the subordinate court of Chawk Munda, sidestepping the need for a police investigation to file charges that would be necessary at a normal criminal court.

Goshe said the court is finally complying after months of deadlock because the multiple charges against the kidnappers cannot be ignored. Previous court hearings focused on Saba’s alleged conversion to Islam to mitigate the charges of her kidnapping, but the judiciary could not ignore the three suspects’ subsequent crimes of trespassing and attempting to burn down the Masihs’ house, he said.

In January, lawyer Akbar Durrani of the Centre for Legal Aid Assistance and Settlement (CLAAS) filed an appeal to register kidnapping charges against Ali, the husband of Saba. Durrani had tried to register these charges in December, but Judge Malik Saeed Ijaz refused the case since it was built upon the testimony of Saba’s sister Aneela, whose status as a minor invalidated her testimony.

Instead, the judge ordered Ali to pay a dowry of 100,000 rupees (US$1,255) and allow her parents to visit, both required by Pakistani marriage protocol. Saba, however, relinquished her dowry, a prerogative provided by sharia. Her family suspects that she made this decision under threat.

 

Struggling Family

Attempts by Saba’s family to contact and visit her have been thwarted by Ali’s Muslim family members, despite a court order for visitation rights.

“We have heard nothing from Saba,” said Raheel, her uncle. “Once we tried to visit her, and [Ali’s family] ran after us and tried to shoot us. But the judges did not do anything.”

The seven months of legal battling have taken their toll on Saba’s family. Her parents have eight children but have been unable to send their sons to school due to the ongoing costs of the case, even though CLAAS has undertaken it pro bono.

The girls’ uncle has been trying to maintain the family’s quality of life as they struggle to get Saba back and their legal options dwindle.

“This year I will try my best to help them and send them to a school,” said Raheel.

Aneela continues to adjust to life back with her family, away from captivity. She is preparing to resume her schooling.

 

Common Crime

Kidnapping and rape victims in Pakistan are often Christians, since the influence of sharia on the country’s judicial system means they can be unofficially treated as second-class citizens.

Last month Muslims allegedly abducted and raped another 13-year-old Christian girl. CLAAS reported that two men kidnapped Ambreen Masih in the industrial city of Sheikupura, located northwest of Lahore. Her attackers threatened to her keep silent, and she was abducted a second time this month before her parents discovered the crime, according to a CLAAS report.

The family filed rape charges against the two kidnappers in Sheikupura, but policeman have not yet taken legal action, according to CLAAS.

PAKISTAN: DOWRY DEMANDED FROM CAPTOR OF CHRISTIAN GIRL


Lawyers try to put financial pressure on husband to secure 13-year-old girl’s release.

ISTANBUL, December 16 (Compass Direct News) – After a judge yesterday placed new financial and social pressure on the captors of a Pakistani girl who was kidnapped and converted to Islam, attorneys have guarded optimism they can return her to custody of her Christian parents.

Judge Malik Saeed Ijaz ordered the girl’s husband, Amjad Ali, to pay a dowry of 100,000 rupees (US$1,275) and allow her parents visitation rights, two actions required by typical Pakistani marriage protocol. At press time he had done neither.

The judge gave Saba Masih, 13, the opportunity to talk with her family during yesterday’s hearing, but she remained mostly silent behind her veil, offering only blunt replies.

“I don’t want to see my parents. They are Christians and I am a Muslim,” she said, according to her parents’ attorney.

Her younger sister Aneela Masih, who was also kidnapped but returned to her family three months ago, pleaded with her older sister to return home. The 10-year-old told her that Christmas was coming and she didn’t want her sister to spend it with those “who are not our people.”

Saba Masih appeared at the Multan branch of Lahore’s High Court yesterday along with her Muslim husband and his family. Her parents filed a contempt petition last month against her captors for failing to follow Pakistani marriage protocol.

Islamic law (sharia), however, gives a wife the right to relinquish a dowry. Lawyers said they fear that the Muslim family will pressure Saba Masih to claim this right in order to offset growing financial pressure.

Lawyers hope that if her mother can visit her, it will convince her to leave her husband and come home to the family; her family believes he has threatened her with violence if she attempts to rejoin them.

At Monday’s hearing, Saba Masih still appeared reluctant to return to her family. Relatives said they were praying that she would change her mind and that the captors would lose their influence over her.

“The main thing is Saba must be ready herself to come back,” said her uncle, Khalid Raheel, the family spokesman. “But she isn’t ready to come back yet, and I don’t know how they are convincing her.”

On Wednesday (Dec. 17) the judge is expected to adjourn the case and issue a deed requiring Ali to pay the dowry at the convenience of the Masih family. The judge yesterday threatened Ali with prison time if he failed to carry out this order.

Akbar Durrani, attorney for the Centre for Legal Aid Assistance and Settlement (CLAAS), said the attorneys might try to use Aneela Masih’s testimony of kidnapping to take the case to the Supreme Court if other options fail.

 

Prostitution Business

The Christian family’s lawyer said the attempt to force Ali to pay a dowry was a tactic to mount financial pressure on Saba Masih’s husband and to convince her to return home. Her family and their lawyers believe she has stayed with her Muslim husband because he and his family have issued death threats.

The Christian family’s chances of winning run against the judicial status quo for Pakistani religious minorities, but the new push comes after a Sept. 9 ruling that returned Aneela Masih to her parents, a rare legal victory for non-Muslims.

“We filed this [contempt] petition so she would come into the court, see her family and hopefully change her statement,” said Durrani of CLAAS. “We also want to put pressure on the Muslim family members because they are afraid of litigation, since they have to pay all these legal expenses.”

Aneela and Saba Masih were kidnapped on June 26 while traveling to visit their uncle in Sarwar Shaheed, northwest of Multan. Their parents say local fruit vendor Muhammad Arif Bajwa and three others kidnapped them in Chawk Munda, a small town in south Punjab.

Saba Masih was married to Ali the next day. Bajwa and Ali registered a case with the police on June 28 for custody of the girls based on their alleged conversion to Islam.

Local residents regard the men as serial kidnappers with connections to a human trafficking ring. The girls’ first defense attorney believed they could have been raped and sold to a brothel.

Ironically, attorneys said, the kidnappers’ alleged desire to exploit Saba Masih may now be the best hope of her returning to her parents, as keeping her has become not lucrative but increasingly costly with court hearings continuing and legal fees multiplying.

“These [kidnappers] don’t have an emotional link to Saba,” Durrani told Compass by phone. “They are in the business of prostitution and only wanted to use these girls for their business.”

Prosecuting attorneys said they have a growing optimism that they can regain custody of Saba Masih, something they thought unlikely two months ago.

 

Long, Hard Battle

In previous hearings, a judge allowed Saba Masih to choose whether or not she would return to her family, even though Pakistan marriage law requires the approval of legal guardians at the age of 16.

The judge determined that her age was 17 based on her testimony and a report by a medical board pressured by Muslim groups to inflate her age. He did not accept as evidence her birth certificate and baptismal record that showed her age as 13.

Younis Masih and his wife first saw their daughters after their kidnapping at a July hearing. The girls were in the company of 16 Muslims and were said to be under pressure to claim they had converted to Islam.

After Aneela Masih returned to her family in September, she claimed that their captors threatened to kill them and their family if they did not do everything asked of them.

Previously it had been reported that she was raped while in captivity, but there was no medical evidence that she was sexually abused or manhandled, lawyers said.

Her sister appears to be suffering, Durrani said.

“The family has told us that Saba Masih is not in good condition – most of the time she cries and is not satisfied there,” Durrani said.

 

Recurrent Problem

Kidnapping of Christians in the Muslim-majority nation of 170 million is not uncommon. Many captors believe they will not be convicted if caught due to the penal code’s influence by sharia, which grants non-Muslims second-class status in society.

Every year there are cases of Pakistani Christian children kidnapped, killed or exploited by those who believe their parents are powerless.

Last month a Muslim family in Nankan kidnapped the 7-year-old son of Pakistani Christian Binyamin Yusef, 30, over a land dispute. Two days later police found his son’s body, which showed signs of torture and rape.

Police did not register the case when Yusef initially approached them. CLAAS representatives hope to open court action against the alleged perpetrators.

PAKISTAN: PARTIAL VICTORY SEEN IN RULING ON KIDNAPPED GIRLS


With both minors saying they had converted to Islam, lawyers feared worse.

ISTANBUL, September 15 (Compass Direct News) – Christian human rights lawyers in Pakistan saw a partial legal victory in a judge’s ruling last week that one of two kidnapped girls be returned to her Christian parents. The judge further ruled that her sister be free to choose whether to go with the Muslim man who allegedly forced her to convert and marry him.

Justice Malik Saeed Ejaz ruled on Tuesday (Sept. 9) that 10-year-old Aneela Masih be returned to her parents – an unprecedented legal victory for Christian parents of a girl who supposedly converted to Islam, according to one lawyer – while leaving her sister, 13-year-old Saba Masih, free to choose whether to go with Amjad Ali, a Muslim man who married her after the June 26 kidnapping.

Saba Masih, whose birth certificate indicates that she is now 13 but who testified that she is 17, said she did not want to return to her parents and tried to keep her little sister from returning to them. Their Muslim captors have repeatedly threatened the two girls that their parents would harm them if they returned.

The older sister is not willing to meet with any of the family members or her parents, said Rashid Rehman of the Human Rights Commission of Pakistan.

“It’s normal behavior,” he told Compass. “She was tutored and brainwashed by the family of her husband Ali, and naturally they made up her mind that her parents will hurt her and treat her inhumanely. In fact that will never happen. Her family is really peaceful, and remained so peaceful the whole time the case was heard in high court.”

After more than three hours of heated legal arguments in the Multan branch of Lahore’s High Court, the judge deemed the oldest child sui juris – capable to handle her own affairs – based on her testimony that she is 17 years old and on a Lahore medical board’s ruling that she is between 15 and 17. The medical board may have been pressured to declare Saba Masih as an adult, according to the parents’ lawyers.

Conditions set in the ruling called for the parents not to “interfere” with Aneela Masih’s religious beliefs, that they be allowed to visit Saba Masih and that the groom’s family pay them 100,000 rupees (US$1,316) according to Pakistani marriage tradition.

Raised in a Christian family in the small town of Chowk Munda, the two girls were kidnapped on June 26 while traveling to visit their uncle in Sarwar Shaheed, northwest of Multan. Saba Masih was married to Ali the next day, and the kidnappers filed for custody of the girls on June 28 based on their alleged forced conversion to Islam.

Islamic jurisprudence and Pakistani law do not recognize the forced marriages of minors.

 

‘Pleased with Outcome’

“We are pleased with the outcome,” said Joseph Francis, head of the Center for Legal Aid Assistance and Settlement (CLAAS). He said, however, that the verdict was not complete without the return of Saba Masih to her family.

Francis and two other CLAAS lawyers were present at the Sept. 9 judgment despite repeated threats against their office over the course of the hearings.

CLAAS lawyer Akbar Durrani told Compass that it was the first time in his life that he had seen such a decision. “In my experience they have not given us the custody of minor girls even as young as 9 years old that have been declared Muslim,” said Durrani, who has been practicing law in Pakistan for 18 years. “It is a legal victory.”

As a minor, though, Aneela Masih’s previous declaration that she had converted from Christianity to Islam was not explicitly recognized. Calling the lawyers into his private chamber to present options before ruling, according to the parents’ lawyers, the judge said he would make no mention of the girls’ supposed conversion to Islam.

“This was a very favorable thing for us,” said Durrani. “He said, ‘I’m only going to decide the custody,’ so we decided this is acceptable to us.”

In his private chamber, the judge gave them different options, warning them that if they didn’t cooperate or accept his proposals he would make his own judgment. In the end he said he would hand the little girl to her mother and set the other free.

“Wherever she wants to go she can go,” the judge told the parties. “But if she wants to go with you she can go, and if she wants to go to her husband she can go.”

The girls, their mother and Ali were then invited into the judge’s chamber, where the judge announced the decision to them.

Durrani said that Aneela Masih went to her mother willingly, while her older sister gave a cry and tried to pull the 10-year-old back to her.

“The minor resisted for a fraction of a second to go to the mother,” Durrani said. “The little girl was under pressure; every time she was instructed by her elder sister not to talk to her mother.”

Her mother hugged her, and the lawyer said the little girl seemed very comfortable in her lap. There her mother tried to remove the veil from her daughter to look at her, but she resisted. Outside the courtroom, however, Aneela Masih removed the veil herself and later accepted food and drink. The girls had been fasting during Ramadan.

The lawyers said it was clear from the 10-year-old girl’s reactions that she was confused from the ordeal.

 

Supreme Court Question

Lawyers for the parents are weighing the options and feasibility of getting the oldest daughter back through the Supreme Court.

On Friday (Sept. 12), the girls’ uncle, Khalid Raheel, who has spearheaded the efforts to get them back, told CLAAS lawyers that Aneela was readjusting into her life at home. Raheel asked the family lawyers that they continue to try to get Saba back.

Rehman said he does not think the case would stand in the Supreme Court. “She willingly said, ‘I don’t want to go with my parents,’” he said.

Durrani and Francis, however, said they would continue to fight for her. “We’ll go to the Supreme Court for Saba,” said Francis.

“We will try getting the statement of Aneela and then will re-open the case,” said Durrani, adding that Aneela Masih had told her family, “Please get her back from that place.”

Rehman told Compass in a phone interview that Saba Masih’s statement that she is 17, her supposed embrace of Islam and her marriage by consent will make getting her back very difficult.

“She has admitted the marriage at the court and produced the marriage papers and has claimed that she’s over 16, so it was very difficult for us to prove our case that she’s a minor girl… because it is denied by Saba herself,” said Rehman.

He explained that the only way to secure the oldest daughter’s return to her family would be by proving she is a minor, something virtually impossible at this point because of her testimony. The court has refused to admit her birth certificate as evidence.

Saba Masih still refuses to communicate with her parents.

 

‘Frightened, Small Girl’

In court last week, both sisters sat in hijab dress fully veiled next to a policewoman from the Dar Ul Rahman women’s shelter, where the two girls had stayed since a July 29 hearing.

Their mother tried to talk to them and show them photos. Durrani said that Aneela Masih was responsive to her mother, but her older sister would pull her away, forbidding her from talking to her.

The judge had ruled that the girls stay at the shelter in order to think of their alleged conversion to Islam away from external pressures. Lawyers for the parents said that while in the shelter the girls were continually harassed and threatened that their family would not take them back.

Aneela Masih stated to the lawyers and her parents after the court decision that Ali’s family and their captors told them that everyone was Muslim – the lawyers, the judge, society – and that their parents could not take them back.

Knowing the attention the case of the two girls had attracted, Durrani said, the judge left the case till last. Yet the courtroom, he said, was full of “those who had kidnapped the girls, their supporters, the Islamic fanatics; all these were present in the court and interested in the hearing of the case.”

From the outset at last week’s hearing, the judge wanted to ask Aneela Masih questions about Islam to extract a statement on which he could rule on her custody. Durrani and colleague Justin Gill fought against the lawyer and the judge, arguing that as the 10-year-old was a minor, her statement on faith could not be valid and that she must be returned to her mother.

“We concentrated our efforts on Aneela, that at least we should have some relief to get her back and then we can fight in the Supreme Court if we wish to go for any other thing,” he said, referring to the older sister’s case.

The judge had decided to postpone the verdict till this Thursday (Sept. 18) and place the girls back in the Dar Ul Rahman shelter, where their mother could visit them for two hours every day. But the CLAAS lawyers said they feared waiting would only work against their case in the long run, making it more difficult to gain custody of the younger sister if both were exposed to more harassment and possible brainwashing.

“Even if she is a Muslim and has changed her religion, according to Islam a mother is the best custodian of the child,” Durrani said he and Gill argued.

Rehman said that Aneela Masih seemed frightened and, according to information he had obtained, the girl was afraid of her abductors and her own family even while in the shelter.

“She was a frightened, small girl,” he said. “They told her that if she returned to her parents she’d be treated unkindly.”

 

Threats, Car Chase

On Sept. 8, the day before the hearing, while traveling together from Lahore to Multan, the three lawyers for the Christian parents – Francis, Durrani and Gill – received threatening calls from the supporters of the girls’ kidnappers.

That night while, on their way back from dinner to a bishop’s house where they were staying in Multan, the CLAAS team was approached by armed men on motorcycles who threatened them, warning them to not go to the judgment hearing the next day.

“They said, ‘You should not be in court or you will be responsible for the consequences,’” said Durrani.

When nearby police saw the scene and approached, the armed men left the scene.

“We were afraid, but we knew we had to go,” Durrani said.

After the hearing, while traveling back to Lahore, Durrani said that Muslim fanatics chased them for about 100 kilometers (62 miles).

“Then we went to another city and got to the highway from another shortcut,” he said.

Durrani said the lawyers have many cases like this, causing them concern for their own safety.

“It is not the first time we get threats, but by the grace of God, and by the refuge of our Holy Ghost we are safe,” he said. “Every time we know the prayers of our church and other Christians are with us, which is why we are able to get the victory for our Lord.”

Muslim kidnappers continue to pressure girls at shelter: ‘Your parents will kill you.’

ISTANBUL, August 20 (Compass Direct News) – A custody battle in Pakistan over two Christian girls kidnapped and allegedly forced to convert to Islam remained inconclusive after a hearing today, with rights advocates for the family suspecting Muslim fundamentalists of pressuring the minors and a medical board.

Judge Malek Saeed Ejaz of the Lahore High Court’s Multan Branch set the next hearing for Sept. 9 after a two-hour proceeding. Lawyers for the Masih family said that if the girls are not returned to their parents at the next hearing they will appeal to the Pakistani Supreme Court.

Until then, Aneela and Saba Masih, 10 and 13 respectively, will remain at Multan’s Dar Ul Rahman women’s shelter, where they have stayed since a July 29 hearing.

Islamic jurisprudence and Pakistani law do not recognize the forced marriages of minors. The judge’s decision to extend the case was based on Saba Masih’s testimony that she is 17 and on a Lahore medical board’s ruling that she is between 15 and 17.

The medical board, however, may have been pressured to declare Saba Masih an adult, lawyers said.

“This is a case of conversion from Christianity to Islam, so we can say there is pressure, especially from fundamentalist groups,” said Aneeqa Maria, legal advocate for the Lahore-based Center for Legal Aid Assistance and Settlement (CLAAS)

Rights advocates said the girls themselves may have come under pressure while at the women’s shelter, although they were sent there with the purpose of escaping coercion by the Muslim family that captured them.

The Muslim family continues to threaten the girls at the shelter, said Rashid Rehman of the Human Rights Commission of Pakistan.

“They are giving them misinformation regarding their parents, saying, ‘If you return to your parents, they will kill you,’” he said.

The court has not accepted Saba Masih’s baptismal records or birth certificates as evidence of her minor status in previous hearings.

Pakistani law requires females to be at least 16 to marry without permission of legal guardians. A minor cannot marry regardless of his or her religion.

Both sides agree Aneela Masih is a minor and that therefore custody of her cannot be granted to the captor’s family. The lawyers for the defense argue, however, that custody of her should be given to her older sister and not to her Christian parents.

A strict interpretation of Islamic law does not allow non-Muslim parents to have custody of a Muslim child.

The prosecution says there is no proof the girls converted freely to Islam, and that they should be given back to their Christian parents. In fact, the Muslim family’s claim to custody of the girls doesn’t even meet the legal muster of Islamic jurisprudence, Rehman argued.

“There is no example in Islamic history of minor girls who converted to Islam without permission or the presence of their legal guardian,” he said. In Islamic law, “women do not have full capacity to give testimony in court. How is it possible to accept the statement they have embraced Islam?”

 

Possible Outcomes

Maria of CLAAS speculated that the court would give custody of Aneela Masih to her parents at the Sept. 9 hearing. Since both sides agree she is a minor, the prosecution will argue she doesn’t understand what has been happening and could not have freely chosen to convert.

Rehman said pursuing custody of the older sister would be more difficult.

“It will not be fruitful for us, because Saba herself has claimed she is married,” he said. “She has attained the age of puberty and is claiming to have married by her own choice. She has also claimed she is 17 years old. She will likely be given custody to her Muslim husband.”

If both girls aren’t returned to their Christian parents, then the prosecution plans to appeal to the Pakistan Supreme Court.

An Aug. 6 hearing at the Lahore High Court’s Multan branch ruled that the district medical board of Multan should examine Saba Masih to determine if she was old enough to marry of her own volition. In previous hearings she claimed she was 17.

A crowd of about 20 people gathered at the courthouse today and shouted threats at the Masih family and their lawyers. Among those in the crowd were Islamic scholars from Mufti groups, which have also made threatening telephone calls to CLAAS for trying to give Christian parents custody of Muslim children, Maria said.

The two sisters were kidnapped on June 26 while traveling to visit their uncle in Sarwar Shaheed, northwest of Multan. Their parents say local fruit vendor Muhammad Arif Bajwa kidnapped them in Chawk Munda, a small town in south Punjab.

Saba Masih was married to Amjad Ali, a Muslim, the next day. Bajwa and Ali registered a case with the police on June 28 for custody of the girls based on their alleged conversion to Islam.

Younis Masih, the girls’ father, claimed Ali and his family kidnapped the girls while they were en route to visit their uncle. He only learned of their location after the men filed for custody and summoned Masih to the police station.

In a July 29 hearing, Judge Saghir Ahmed said he did not believe the girls converted to Islam of their own volition and ordered them to be sent to a government women’s shelter so that they could think freely until the Aug. 6 hearing.

The girls’ father has tried to gain custody of his daughters by appealing to Islamic authorities. On July 10 he obtained an edict from Chawk Munda imam Mohammad Abdul Majeed on whether his 13-year-old daughter’s marriage was valid according to Islam.

Majeed replied that a 13-year-old girl’s marriage is valid if she has attained puberty and freely chosen to convert. If Saba Masih’s conversion were coerced, then her marriage would be invalid because Islam does not allow compulsion in religion, he said.

Majeed’s ruling, however, was not accepted in previous hearings since he declined to appear in court and testify.

 

Kidnapping and Threats

Today’s hearing in Multan came during increased kidnappings of Christian minors and threats against legal activists in Pakistan, a majority-Muslim country of 168 million.

Phone threats from Islamic groups have forced Maria, lawyer for a Christian legal advocacy group and counsel for the Masih family, to go underground for the last two weeks.

CLAAS has come under scrutiny for taking up cases of the forced conversion of kidnapped girls such as the Masih sisters and that of Sonia Younis, 13. On June 24 a Muslim woman in Lahore kidnapped Younis and married her to her son, Mohammead Imran.

When Younis’ parents filed a complaint with a local police station, an investigator returned three days later with a certificate stating Younis had become a Muslim and married Imran. Younis’ parents charged Imran’s parents with kidnapping, but police dismissed it on religious grounds, according to CLAAS.

Kidnappings of non-Muslims are common in Pakistan, where the Christian population is less than 2 percent.

“Generally, because the courts are biased, they give custody to the Muslims,” Maria of CLAAS said. “In many cases the girls are minors. These kinds of cases are similar to others.”

Attorney, relative of Christian parents fear they are likely to lose custody of daughters.

ISTANBUL, August 12 (Compass Direct News) – Amid pressure from radical Muslim clerics, a medical board is expected to determine the age of a Christian Pakistani girl allegedly forced to convert to Islam. The medical report on 13-year-old Saba Masih, who married a Muslim man, is due by her Aug. 20 custody hearing.

The custody battle over her and her 10-year-old sister, Aneela Masih – two girls raised as Christians who were kidnapped and allegedly converted to Islam – may be decided on their testimonies even though they contradict court evidence. Saba Masih, married off to the Muslim man after the kidnapping, has twice claimed in court that she is 17 years old – Pakistani law requires females to be at least 16 to marry without permission of legal guardians.

At a hearing last Wednesday (Aug. 6), the Lahore High Court’s Multan branch ruled that the district medical board of Multan will examine Saba Masih to determine if she is old enough to marry of her own volition. Aneela Masih claims to have embraced Islam, though as a minor she cannot legally do so.

The court has refused to accept the girls’ birth certificates or baptism records as evidence for their ages. Under Pakistani law a minor cannot marry regardless of his or her religion.

In a July 12 ruling, District and Sessions Court Judge Main Naeem Sardar awarded custody of the girls to the kidnappers based on Saba Masih’s testimony that she was 17 and had converted to Islam. He did not accept the girls’ birth certificates as evidence of their ages.

In a July 29 hearing, Judge Saghir Ahmed said he did not believe the girls converted to Islam of their own volition and ordered them to be sent to a government women’s shelter, so that they could think freely until the Aug. 6 hearing.

At that hearing, however, both girls claimed to have embraced Islam, and Saba Masih claimed once again to be 17 and thus able to marry. Judge Saeed Ejaz ordered that she be sent to a medical examination to determine her real age.

Muslim clerics are already threatening the medical board, claiming that since the girls have embraced Islam they should not be returned to the custody of their Christian parents, said Khalid Raheel, the kidnapped girls’ uncle.

“Muslim clerics are threatening the judge. [Saba] said she was 17 because she was threatened,” he said. “[The judge] told the medical officer to get her age checked by the medical board … [but] Muslim clerics are threatening the medical board.”

The medical board will submit its report at the next hearing on Aug. 20.

Rashid Rehman, a lawyer representing the Christian parents, said that if the report says Saba Masih has reached puberty or is between the ages of 16 and 17, then the court will likely award her Muslim husband custody over her – even though her marriage is invalid since she is a minor.

“The law has been amended, and no minor can be contracted into marriage with [guardian or parental] permission or without permission,” he said. “But because of religious pressure, the court can decide otherwise.”

The court cannot grant custody of Aneela Masih to the kidnappers since both sides agree she is 10. Because she reiterated at the August 6 hearing that she had converted to Islam, however, it is not clear if she will be returned to her Christian parents.

According to a strict interpretation of Islamic law, a non-Muslim cannot have custody of a Muslim child.

“I think Aneela will not be given to the parents but sent to a shelter or child protection care bureau,” said Rehman, a member of the Human Rights Commission in Pakistan. “She can’t reside with the parents, who are Christians.”

After the hearing, the sisters were returned to the government-run Dar-Ul-Aman women’s shelter, where they have stayed since July 29. They have been forbidden from seeing their parents or the Muslim kidnappers.

 

Threats Continue

The kidnappers, however, continue to intimidate the girls, said Raheel, their uncle.

“Even in the women’s shelter run by the government, they keep on calling them on the phone,” he said. “They keep on threatening them there also. That’s why they can’t change their minds.”

He said the kidnappers are threatening the girls’ parents to stop trying to regain custody of their daughters.

“They told them not to go to court, or they would kill them,” Raheel said.

Attorney Rehman said the courthouse at the Aug. 20 hearing could be a charged environment, since the local press has published stories advocating the kidnappers’ claims.

Raheel noted that the local Urdu papers, Jang and Xpress, quoted the kidnappers as saying the Christian family was threatening them for the return of their daughters even though they had freely chosen to become Muslims.

A priest at the Masih family’s parish known only as Father Asab said many Muslims have expressed their sympathy to the Christian family but are afraid of speaking out against the perpetrators.

“Many Muslims are also with us, those who understand,” he said. “But the majority is afraid to tell the truth. In this case many people in our area, many Muslims, know that those who kidnapped the girls … have a bad name in society. But even Muslim families are frightened to tell the truth.”

PAKISTAN: CHILDREN IN CONVERSION DISPUTE SENT TO SHELTER


Court questions whether girls were free from outside pressure.

ISTANBUL, July 29 (Compass Direct News) – A Pakistani court today took over supervision of two children in a custody battle that appears to hinge on their disputed conversion from Christianity to Islam.

At a hearing in Multan, 200 miles southwest of Lahore, Judge Saghir Ahmed ordered Aneela and Saba Masih, 10 and 13 respectively, to be temporarily placed in a government-run women’s shelter.

The provincial high court judge said that he did not believe the children had been free from external pressure when testifying that they had converted to Islam. Ahmed sent the sisters to Multan’s Dar-Ul-Aman women’s shelter, forbidding them to see their parents and Muslim caretakers until an August 4 hearing, when they will again testify.

According to a lawyer representing the Christian parents, the court’s emphasis on the genuineness of the children’s conversion is irrelevant.

“It is not a matter of embracing Islam – the parents have a right to their children under the law,” said advocate Rashid Rehman of the Human Rights Commission of Pakistan.

But according to Rehman, the judge may have acted under pressure from fanatical Muslim clerics.

The sisters’ uncle, who also attended today’s hearing, agreed.

“Muslim clerics have threatened the judge that if he allows the girls to go with the Christians, they will kill him,” Khalid Raheel said.

Aneela and Saba Masih attended today’s hearing in the company of Amjad Ali, a Muslim who married the elder sister on June 27, the day after she disappeared. The girls’ father has accused Ali and his relatives of kidnapping the children while they were traveling from their home to visit their uncle in Sarwar Shaheed, northwest of Multan.

Younis Masih only discovered his daughters’ location when he found that Ali and another local, Muhammed Arif Bajwa, had filed a case against him for custody of his children. Their claim was based on Aneela and Saba Masih’s alleged conversion to Islam.

Under one interpretation of Islamic law, a non-Muslim may not have custody of a Muslim.

Bajwa was unavailable for comment when Compass attempted to contact him by telephone multiple times today.

In a July 12 ruling, District and Sessions Court Judge Main Naeem Sardar upheld the Islamic law rationale, awarding the alleged kidnappers custody of the girls based on their conversion to Islam. Sardar refused to accept the children’s birth certificates as proof of their age, relying solely on 13-year-old Saba Masih’s testimony that she was 17 and had converted and married of her own volition.

Under Pakistani law, a woman can marry without the approval of legal guardians at the age of 16.

Younis Masih appealed the decision with the help of lawyer Rehman, appearing today before Ahmed at the Lahore High Court’s Multan bench. During the entire hearing, Ali and nine relatives remained around the children in the courtroom, issuing them instructions, Rehman said.

“Even when the court allowed the girls to approach their parents, [Amjad Ali’s relatives] were standing around them,” said the lawyer.

According to Rehman, the 13-year-old girl angrily shoved her mother away when the judge allowed the two to approach one another.

“I do not want to talk with you, I don’t want to go with you, I don’t recognize you,” the child shouted, according to Rehman. “I am a Muslim and you are a Christian.”

The lawyer said that Aneela Masih, 10, was unable to respond to questions from the judge and appeared to be in a daze. The young child’s uncle, who also attended the hearing, said that she had been especially attached to her father.

Raheel said that the children’s parents were devastated by their daughters’ response to them at the court.

After the hearing, Younis Masih told Compass that he and his wife had begun fasting and praying for their daughters’ safe return.

“Please pray that the Lord protects their minds and brings them back to us,” he said.

Lawyer Rehman accused police of taking sides with the Christian girls’ kidnappers at today’s hearing. He said that Sub-Inspector Muhammad Aslam, charged with delivering the girls to the women’s shelter, had allowed Ali and his relatives to mingle with the sisters following the hearing. But when the children’s mother approached them, he blocked her path.

Contacted by Compass, Aslam claimed to have no knowledge of the case. Muzaffargarh SP Investigation Official Chaudry Tajeen was also unavailable when Compass contacted his office to ask why police had refused to file a kidnapping case when the Christian children first went missing.

Last week Punjab Chief Minister Shahbaz Sharif called on provincial police to take measures against an increase in incidents of kidnapping for ransom. According to a July 22 article in Pakistani daily The News, Sharif ordered officials to acquire equipment to track telephone calls from kidnappers demanding ransom.
