Microsoft’s takeover would be a win for TikTok and tech giants – not users

In what seems to be a common occurrence, Chinese video-sharing app TikTok is once again in the headlines.

After months of speculation about national security risks and users’ data being harvested by the Chinese Communist Party, US President Donald Trump has announced plans to ban TikTok in the United States any day now.

In response, a deal is being negotiated between TikTok’s parent company ByteDance and US software giant Microsoft. If successful, Microsoft will take over the app’s operations in the US and potentially also in Canada, Australia and New Zealand.

A US ban would not be unprecedented. India barred TikTok last month, alongside dozens of other Chinese-owned apps and websites.

The Microsoft deal

According to reports, ByteDance has agreed to sell some of its TikTok operations to Microsoft. The deal, which is unlikely to progress before mid-September, would appease US regulators and could be seen as a way forward for TikTok in Australia.

Microsoft has indicated any takeover would include a complete security review and an offer of:

… continuing dialogue with the United States government, including with the president.

Moving ownership to a US company could help address concerns surrounding the perceived influence of the Chinese government over TikTok. But there will need to be strong oversight to ensure existing user data is transferred entirely to Microsoft’s control.

While Microsoft has pledged to ensure TikTok data are deleted “from servers outside the country after it is transferred” – it would be difficult to prove copies had not been made before control was handed over.

What’s more, a Microsoft-owned TikTok may not appeal to everyone. Some may think Microsoft is too closely tied to the US government, or may consider it a monopoly holder in the personal computing market.

Also, it would be naive to think foreign governments will not be able to covertly access US-stored user data, if they are so inclined.

Who will benefit?

Should the deal go ahead, it may open an opportunity for the Australian and New Zealand governments to align with a US-supported initiative.

Australia is still deciding how to proceed, with the Senate Select Committee on Foreign Interference through Social Media due to hear from TikTok representatives on August 21. The committee has been tasked to look at the influence of social media on elections and the use of such platforms to distribute misinformation.

TikTok won’t be alone though – Facebook and Twitter are both due to attend. It is, however, unlikely the Microsoft acquisition will have much influence on the proceedings as the deal is still in the early days of discussion.

Microsoft’s acquisition may introduce fresh concerns about the US government’s influence over TikTok. Although, this is perhaps more politically palatable than potential Chinese government influence over the app – given the Chinese Communist Party’s unsavoury record of privacy abuses.

Perhaps the only winner from the deal would be ByteDance itself. A product that is increasingly disliked by foreign governments will only become harder to sell with time. It would make sense for ByteDance to cash out its asset sooner rather than later.

The deal would also likely earn it a significant payout, given TikTok’s millions of users.

Are the risks real?

Despite ongoing allegations, there is no solid evidence of a threat to either national security or personal data from using TikTok. Many of the concerns hinge on data sovereignty – specifically, where data are stored and who can use and access them.

TikTok has responded to allegations by stating its user data are not stored in China and are not subject to Chinese government influence or access.

That said, while TikTok user data may well be stored outside China, it is unclear whether the Chinese government has already secured access, or will seek to do so later through legal channels.

There are, however, other potential issues that may be driving the US’s concerns.

For instance, in 2018 an unexpected consequence of sharing fitness tracker data through the Strava website inadvertently revealed the locations of secret US military bases.

Thus, services such as TikTok which are meant to be relatively benign (if used ethically) can, under certain circumstances, present unexpected threats to national security. This may explain why Australia’s defence forces have banned the app.

Another Trump power move?

Threats from the US against TikTok are not new.

The country’s Secretary of State Mike Pompeo indicated TikTok was being examined by US authorities in early July. And suggestions of a national security review go as far back as November last year.

However, in regards to Trump’s most recent threat, one contributing factor may be the personal feelings of the president himself.

There are theories much of the new hype over TikTok could be a reaction from Trump to an ill-fated political rally in Tulsa.

A number of TikTok users reserved tickets to the Trump rally and didn’t show up, as a protest against the president. The rally saw only a few thousand supporters attend, out of hundreds of thousands of allocated tickets. The Conversation

The ACCC is suing Google over tracking users. Here’s why it matters

The Australian Competition and Consumer Commission (ACCC) today announced it is suing Google for misleading consumers about its collection and use of personal location data.

The case is the consumer watchdog’s first move against a major digital platform following the publication of the Digital Platforms Inquiry Final Report in July.

The ACCC follows regulators in countries including the US and Germany in taking action against the way “tech giants” such as Google and Facebook harvest and exploit their users’ data.

What did Google do?

ACCC Chair Rod Sims said Google “collected, kept and used highly sensitive and valuable personal information about consumers’ location without them making an informed choice”.

The ACCC alleges that Google breached the Australian Consumer Law (ACL) by misleading its users in the course of 2017 and 2018, including by:

  • not properly disclosing that two different settings needed to be switched off if consumers did not want Google to collect, keep and use their location data

  • not disclosing on those pages that personal location data could be used for a number of purposes unrelated to the consumer’s use of Google services.

Some of the alleged breaches can carry penalties of up to A$10 million or 10% of annual turnover.

A spokesperson for Google is reported to have said the company is reviewing the allegations and engaging with the ACCC.

Turning off “Location History” did not turn off location history

According to the ACCC, Google’s account settings on Android phones and tablets would have led consumers to think changing a setting on the “Location History” page would stop Google from collecting, keeping and using their location data.

The ACCC says Google failed to make clear to consumers that they would actually need to change their choices on a separate setting titled “Web & App Activity” to prevent this location tracking.

Location data is used for much more than Google Maps

Google collects and uses consumers’ personal location data for purposes other than providing Google services to consumers. For example, Google uses location data to work out demographic information, target advertising, and offer advertising services to other businesses.

Digital platforms increasingly track consumers online and offline to create highly detailed personal profiles on each of us. These profiles are then used to sell advertising services. These data practices create risks of criminal data breaches, discrimination, exclusion and manipulation.

Concealed data practices under fire around the world

The ACCC joins a number of other regulators and consumer organisations taking aim at the concealed data practices of the “tech giants”.

This year, the Norwegian Consumer Council published a report – Deceived by Design – which analysed a sample of Google, Facebook and Microsoft Windows privacy settings. The conclusion: “service providers employ numerous tactics in order to nudge or push consumers toward sharing as much data as possible”.

The report said some aspects of privacy policies can be seen as “dark patterns”, or “features of interface design crafted to trick users into doing things that they might not want to do”.

In Canada, an investigation into how Facebook gets consent for certain data practices by the Office of the Privacy Commissioner of Canada was highly critical.

It found that the relevant data use policy “contained blanket statements referencing potential disclosures of a broad range of personal information, to a broad range of individuals or organisations, for a broad range of purposes”. The result was that Facebook users “had no way of truly knowing what personal information would be disclosed to which app and for what purposes”.

Is Facebook next?

The ACCC was highly critical of the data practices of a number of large digital platforms when the Final Report of the Digital Platforms Inquiry was published in July this year. The platforms included Facebook, WhatsApp, Twitter and Google.

The report was particularly scathing about privacy policies which were long, complex, difficult to navigate and low on real choices for consumers. In its words, certain common features of digital platforms’ consent processes:

leverage digital platforms’ bargaining power and deepen information asymmetries, preventing consumers from providing meaningful consents to digital platforms’ collection, use and disclosure of their user data.

The report also stated the ACCC was investigating whether various representations by Google and Facebook respectively would “raise issues under the ACL”.

The investigations concerning Facebook related to representations concerning its sharing of user data with third parties and potential unfair contract terms. So far no proceedings against Facebook have been announced.

Will this change anything?

While penalties of up to A$10 million or 10% of annual turnover (in Australia) may sound significant, last year Google made US$116 billion in advertising revenue globally.

In July, the US Federal Trade Commission settled with Facebook on a US$5 billion fine for repeatedly misleading users about the fact personal information could be accessed by third-party apps without the user’s consent, if a user’s Facebook “friend” gave consent. Facebook’s share price went up after the FTC approved the settlement.

But this does not mean the ACCC’s proceedings against Google are a pointless exercise. Aside from the impact on Google’s reputation, these proceedings may highlight for consumers the difference between platforms which have incentives to hide data practices from consumers and other platforms – like the search engine DuckDuckGo – which offer privacy-respecting alternatives.The Conversation

Facebook: Email Outrage


  1. Facebook just doesn’t learn. If there’s something that Facebook should know by now it’s that the social network’s users don’t like things being forced upon them and having their settings changed without notification and permission. Yet despite this, Facebook has done it again and changed everyone’s default email setting to that of a Facebook email address. Poor form Facebook, poor form. It really annoyed me to find it so today, but thankfully I have processes in place that should warn be of such Facebook ineptness before too much harm is done. Not so for all, so hopefully this story will bring awareness to others, as well as providing information as to how it can be corrected.

Digg and Diggnation


The Digg social network is in trouble. Digg is a place where people can share what they find on the web with others. There is a rating system of sorts – based on people ‘digging’ a post/site, which when done so is considered ‘dugg’ by the one doing the ‘digging.’ It had and has the potential to be a very useful site. However, as anyone who keeps up with developments in social networking and the like knows, Digg is in trouble. It is dropping users, with less and less people using the site and tools associated with the site. Recently Digg got an overhaul which has done nothing to stop the slide.

There was once a newsletter with the top ‘dugg’ stories of the day, but that seems to have vanished. I found it to be a useful newsletter.

There is also a web television show known as Diggnation. I have just watched the latest episode of the show and I confess to believing the show is rubbish. It is not worth watching in my opinion and comes complete with terrible language and crass content. If the quality of the show is how we should take Digg it is no wonder it is in trouble. It is hosted by two men, with one being the founder of Digg – which does nothing for the credentials of Digg.

I still hold out hope for Digg, as it can yet be a very useful and worthwhile site and service.
