As the federal government debates an Indigenous Voice, state and territories are pressing ahead

Queensland Deputy Premier Jackie Trad has announced that the state will begin a conversation about a pathway to treaty with Aboriginal and Torres Strait Islander peoples.

In doing so, Queensland joined Victoria and the Northern Territory in formally commencing treaty processes.

This is a significant development. While the Commonwealth government embarks on another round of important yet time-consuming consultations over a potential First Nations Voice to Parliament, the states and territories are taking the lead on treaties.

Queensland’s ‘track to treaty’

Queensland’s announcement reflects a shift in debate on Indigenous constitutional recognition at the state and territory level. Only a few year ago, the states and territories debated whether to include a reference to Indigenous Australians in their constitutions. Now, they are contemplating negotiating treaties.

Treaties have been accepted globally as the means of reaching a settlement between Indigenous peoples and those who have colonised their lands. They are formal agreements, reached via respectful negotiation in which both sides accept a series of responsibilities.

Treaties acknowledge Indigenous peoples were prior owners and occupiers of the land and, as such, retain a right to self-government. At a minimum, they recognise or establish structures of culturally appropriate governance and means of decision-making and control.

The Queensland treaty process is still in its early stages and negotiations will not begin for several years. This is sensible, because it is important that both the state and First Nations are ready to start negotiations.

For First Nations, this means having a clear sense of what a treaty might mean for their communities, as well as a broad consensus on their negotiating position. Preparing for treaty negotiations can also enable First Nations to engage in nation-(re)building, consistent with their values and aspirations, which is valuable regardless of the content, or even the completion, of a treaty.

For the state, it is equally important that non-Indigenous Queenslanders understand what a treaty is and what it might result in.

Reflecting these preliminary steps, the government has established a bipartisan eminent panel of Indigenous and non-Indigenous Queenslanders, with Indigenous academic Jackie Huggins and former Attorney-General Michael Lavarch serving as co-chairs.

Their responsibility is to provide leadership and engage with key stakeholders across the state. A treaty working group will also be established soon to lead consultations with First Nations, allowing them to discuss and reach agreement on what a treaty might contain.

Others leading the way

These steps follow similar processes in two other states and territories with Labor governments – Victoria and the Northern Territory.

In Victoria, the Andrews government committed to entering treaty negotiations in 2016. An Aboriginal Treaty Working Group was established to lead two rounds of community consultations, which resulted in the creation of a First Peoples’ Assembly. The assembly will not negotiate treaties itself, but will work with the state to develop a treaty framework through which the state and First Nations can negotiate.

At the same time, Victoria also established a Treaty Advancement Commission to maintain momentum for a treaty and keep all Victorians informed.

The process in the Northern Territory is following this pattern. In June 2018, the government signed a memorandum of understanding with representatives of the four Indigenous land councils, committing to exploring a treaty.

Earlier this year, Mick Dodson, the former director of the National Centre for Indigenous Studies at the Australian National University, was appointed NT treaty commissioner. He is currently leading consultations with Aboriginal Territorians.

Why a lack of federal involvement is a problem

These are promising developments, but there are several challenges ahead.

First, treaties are political agreements. As such, they are vulnerable to political fluctuations.

In Queensland, the Liberal National Party opposition wants to look at the government’s announcement in more detail, but has already suggested it would adopt different priorities. If the LNP wins the 2020 state election, it could abandon the process before negotiations even commence.

We have already seen this play out in South Australia. In 2017, the state Labor government formally started treaty negotiations. But within a year, a newly-elected Coalition government stepped away from this commitment.

Second, the federal government’s position is problematic. Ken Wyatt, the new minister for Indigenous Australians, has said the federal government will leave treaty processes to the states and territories.

Federal government involvement is not legally necessary. Queensland has the legal authority to sign and implement a treaty with Indigenous peoples.

However, the Commonwealth parliament has the power to overrule any state or territory treaty. For this reason, it is preferable that the Commonwealth play a role in these processes. The Uluru Statement from the Heart offers an avenue to do so.

In this light, the federal government’s response to the Uluru Statement adds a further complication. The statement calls for

  • A constitutionally enshrined national representative body to advise the federal parliament (known as a “Voice” to parliament); and

  • A Makarrata Commission to supervise a process of agreement-making between governments and First Nations and truth-telling about Australia’s history.

As constitutional lawyer Megan Davis has explained, these reforms are “deliberately sequenced.” The value of starting with a First Nations Voice and Makarrata Commission is that they can oversee developments across the country. Without these bodies, state and territory treaty processes may diverge and result in wildly different settlement terms.

Finally, the support of Indigenous peoples is not assured.

Increasingly, First Nations are resisting agreement-making with governments that act inconsistently with their values and aspirations.

For instance, the Djab Wurrung Embassy, a group of traditional owners protesting VicRoads’ plan to cut down sacred trees, has launched a “No Trees, No Treaty” campaign to highlight the state government’s refusal to listen to their views.

Just last month, the Yorta Yorta Elders Council also rejected a Victorian treaty

as a trip wire and only a pathway to assimilation.

Consensus cannot be assumed, and will become more complex as First Nations articulate their objectives and objections to possible treaties.

What’s next?

Notwithstanding these challenges, Queensland’s announcement is historic.

It confirms that progress on Indigenous constitutional recognition is being led by the states and territories. It also directs more attention to the federal government’s approach to this issue.

It is hoped that the Commonwealth reflects on Queensland’s announcement and commits to establishing a Makarrata Commission. And that commission should be designed by Indigenous representatives serving on a constitutionally enshrined First Nations Voice.The Conversation

TALIBAN THREATENS POPE IF CHRISTIANITY IS SPREAD IN AFGHANISTAN


In the lead-up to his coming trip to the Holy Land, Pope Benedict XVI has been warned by Islamic extremists that he must stop any attempts to convert Muslims to Christianity or face “the consequences of a severe reaction,” reports Hilary White, LifeSiteNews.com.

ANSA news service reports that the Taliban issued the statement on an Islamic website after the Islamic news service Al Jazeera showed American soldiers holding copies of the Bible translated into the two local languages.

“The Islamic Emirate in Afghanistan asks Pope Benedict XVI to act to stop the foolish and irresponsible actions of the crusaders upsetting the feelings of Muslim rebels, without awaiting the consequences of a severe reaction,” said the message on the website, alemarah1.org.

“The Taleban forcefully exhort the mujaheddin [jihadis], scholars and all religious circles to control the activities of the invaders and crusaders, and not allow anyone to preach religions except Islam,” the message continued.

The US army later responded, “Any form of religious proselytism by troops is prohibited,” and assured that the bibles pictured had been “confiscated and destroyed.”

At the same time, Islamic extremists in Jordan condemned the Pope’s visit, claiming that he had failed to apologise for what they regard as insults to Islam in a speech at Regensburg in 2006. The Pope is scheduled to arrive in Jordan on Friday for the first stage of a tour that will include Israel and the Palestinian territories.

Zaki Bani Rusheid, head of the Islamic Action Front, the political arm of the international organisation the Muslim Brotherhood, told Reuters, “The present Vatican pope is the one who issued severe insults to Islam and did not offer any apology to the Muslims.” The Islamic Action Front is the Jordan’s largest mainstream Islamist party.

In 2006, Pope Benedict spoke to an audience at the University of Regensburg where he had once served as professor of theology, on the inherent unity of faith and reason. In it he quoted the Byzantine emperor Manuel II Paleologus, who wrote in 1391, “Show me just what Muhammad brought that was new and there you will find things only evil and inhuman, such as his command to spread by the sword the faith he preached.” The emperor was writing on jihad and of forced conversions of Christians by conquering Muslims.

The comments, after careful management by liberal western news media, prompted a wave of riots and violence by Muslims around the world, including attacks on Christian churches in Israel, the murder of a nun in Somalia and the beheading of a priest in Iraq.

Observers note that there are early signs that the same media that instigated the “Muslim outrage” in 2006 are setting the stage for another round.

The Huffington Post reported at the end of April that in the town of Nazareth a large banner has been stretched across the main square condemning anyone who insults Mohammad. HP’s Diaa Hadid wrote, “The pontiff may have to tread carefully with his visit to Nazareth,” and said that “many Muslims” are still angry over the Regensburg speech. Hadid quotes an Anglican head of a local ecumenical group that Christians in the area fear more violence if the Pope makes any other “contentious” statements on Islam.

The Guardian’s religious affairs correspondent Riazat Butt wrote on Tuesday that Pope Benedict “must” go to Jerusalem as a “penitent pilgrim.” Butt cites 35 Christians, Jews and Muslims who claim that “papal blunders” are sending out “‘divided messages’ on anti-Semitism and inter-faith activity.”

MISSIONARIES EVACUATED FROM MADAGASCAR


Assemblies of God World Missions has evacuated its missionaries from troubled Madagascar, an island nation in the Indian Ocean off the southeastern coast of Africa, reports Dan Wooding, founder of ASSIST Ministries.

Following months of threats and infighting for political position, Madagascar experienced a coup on March 17, as President Marc Ravalomanana apparently chose to step down.

“The military is divided as to who they are going to support,” explains Africa Regional Director Mike McClaflin. “The American Embassy very strongly urged American citizens to evacuate the island . . . and now the American Embassy has evacuated its staff.”

McClaflin says that Assemblies of God World Missions (AGWM) leadership made the decision on March 14, at the recommendation of the U.S State Department, to take AG missionaries in Madagascar out of harm’s way and moved them to Nairobi, Kenya, for the time being.

“With missionaries now in 212 countries and territories of the world, almost no civil uprising, conflict or disaster takes place in the world that does not touch the lives of some of our missionaries,” states AGWM Communications Director Randy Hurst. “The unrest and government takeover in Madagascar affects four missionary families and well as one single missionary.”

Included in the list of missionaries evacuated are the families of Nate and Tammy Lashway, Jay and Carey Rostorfer, and Aaron and Heather Santmyire, Zach and Shellie Maddox, missionaries from East Africa who were visiting the Santmyires, along with short-term MAPS worker Ashley Masten, were also evacuated. The Manny Prabhudas family, who also serve in Madagascar, are currently in the United States on their itineration cycle.

Hurst adds that “Madagascar is an example of how so many of the crises in our world today demand that we as a church must commit ourselves increasingly to intercessory prayer for our missionaries and fellow believers around the world.”

PHILIPPINES: CHRISTIANS FEAR FAILED PACT INCREASES RISK OF REPRISALS


Frustrated Muslim demand for larger autonomous region in Mindanao could lead to war.

DUBLIN, October 6 (Compass Direct News) – Militant Islamists in the southern island of Mindanao have stepped up their attacks on majority-Christian villages following the failure of a peace agreement that would have enlarged an existing Muslim autonomous region there.

With Muslim commanders of the Moro Islamic Liberation Front (MILF) in the southern Philippines yesterday saying ongoing support from the international community was necessary to prevent a full-scale war breaking out in Mindanao, both Muslim and Christian residents in the disputed territories were fearful of what the future might hold.

“The problem is that many people living in these areas don’t want to be part of a Muslim autonomous region,” a source in Mindanao who preferred to remain anonymous told Compass.

“The closer you get to these zones, the more nervous people are,” he said. “The town of Kolambugan, where most of the fighting took place in mid-August, became a virtual ghost town for a while. It had a population of 25,000. But people are slowly returning to their homes.”

A Christian family from the area said many people were afraid to sleep at night because they kept hearing reports that they would be attacked at midnight.

“When MILF forces attack Christian villages, Muslim neighbors are afraid that Christians will retaliate against them, even though they have nothing to do with the violence,” the source added. “This has happened in the past.”

He also explained that some moderate Muslims are drawn to support the MILF because the rebels claim the Christians have stolen their ancestral homelands. Communities in Mindanao often struggle with extreme poverty.

“If MILF is successful in gaining control over these lands, the people assume that their economic situation will improve,” he said. “So although they want the fighting to stop, they sympathize with the MILF.”

While the conflict is primarily political, religion plays a significant role. As a member of the Moro Youth League stated in an Aug. 5 national television interview in the Philippines, “As a Muslim, in order to live in a righteous way, you need to be living under sharia [Islamic] law and with an Islamic government. We believe we have the right to fight for this.”

Other Youth League members on the program agreed that sharia was a primary objective of autonomy, and that Islam was the only “real path of doing anything in this world.”

 

Violence Erupts

Some 2,000 MILF supporters yesterday held a protest march in Marawi city, Lanao del Sur, appealing to the United Nations and the Organization of the Islamic Conference to compel the Philippine government to revive the aborted peace agreement that would have enlarged the existing Muslim autonomous region in the south.

Breakaway MILF commanders on Aug. 18 attacked several majority-Christian villages after the Supreme Court prevented the Aug. 5 signing of the Memorandum of Agreement on Ancestral Domain (MOA-AD). The agreement potentially would have given the MILF power to establish an Islamic state governed by sharia law.

Christian leaders in Mindanao appealed to the Supreme Court when they realized that if they voted against inclusion in the proposed Bangsamoro Juridical Entity (BJE), their majority-Christian villages would become small islands in the midst of MILF-administered territory. As a result, they feared, they would be forced to move elsewhere.

Incensed by the 11th-hour stalling of the agreement, three MILF commanders on their own initiative led attacks against towns in North Cotabato and Lanao del Norte provinces on Aug. 18, burning homes, seizing livestock and killing at least 37 people. Another 44,000 residents immediately fled the area.

When some Christian residents armed themselves in defense, Secretary of Interior Ronaldo Puno warned that anyone carrying weapons would be disarmed.

The MILF has only 11,000 active fighting men, according to local estimates. But by Aug. 20, the National Disaster Coordinating Council had reported a total of 159,000 people displaced by the rebel attacks.

The Philippine army quickly retaliated, sweeping villages in an attempt to seize the rebel commanders.

After two weeks of violent clashes, the Philippine government officially abandoned the MOA-AD. Spokeswoman Lorelei Fajardo said President Gloria Macapagal-Arroyo would seek a new agreement based on consultation with legislators and local politicians rather than negotiations with the MILF.

Furthermore, the government would concentrate on the “disarmament, demobilization and rehabilitation” of MILF cadres, Fajardo said.

In response, MILF leaders rejected any renegotiation of the peace deal with Arroyo’s administration.

 

Overcoming Prejudice

An opinion piece in the Wall Street Journal (WSJ) on Aug. 7 stated that the MOA-AD would only reinforce prejudices between Christian and Muslim communities.

Under the agreement, WSJ claimed, the government would further divide Mindanao into Muslim and Christian enclaves, increasing the likelihood of territorial disputes. Separating Muslims from the rest of Philippine society, it stated, would encourage a vision already held by MILF to help create a pan-Islamic state covering several countries in the region, including Malaysia, Indonesia and Singapore.

Finally, the WSJ said, less Philippine control of Mindanao would “invite even more terrorist activity in an area that already has strong ties to al Qaeda.”

While there are proven terrorist leanings in groups such as the MILF and the Abu Sayyaf, not all area Muslims approve of or engage in such activities.

Camilo Montesa, a key figure in peace negotiations, in his blog on Aug. 30 described an encounter with a young man who believed that Muslim residents would readily seize property from Christians once the BJE were formed.

Others told Montesa that, “Muslims were scouting and marking the big houses of Christians in Cotabato and staking a claim over them in anticipation of the signing of the peace agreement.”

“The hearts and minds of the people are the battlefields, and not some hill or base camp,” Montesa concluded. “There is a limit to what arms and war can produce … It is unfortunate that we are so divided as a people at this point in our national life.”

 

Reclaiming ‘Ancestral Domains’

As Islamic identity strengthened in the Middle East after World War II – and as many Philippine Muslims traveled to study in Middle Eastern countries – certain sectors of the Bangsamoro population became committed to reclaiming “ancestral domains.”

Their claims dated back to the rule of the Sultanate of Sulu, which existed prior to Spanish colonial rule in the 1500s, and the establishment of the Commonwealth of the Philippines in 1935. When the last sultan died in 1936, the fledgling Philippine government refused to recognize his heir, effectively eradicating the traditional Bangsamoro power base.

When the Philippines became a republic in 1946, its constitution allowed for the establishment of an autonomous region in Muslim Mindanao. Initially the Moro National Liberation Front (MNLF) fought alone for this autonomous territory; in 1977, however, MNLF member Hashim Salamat – who had studied in Saudi Arabia – and his followers seceded from the movement and founded the rival MILF.

The Philippine government signed an agreement with the MNLF in January 1987, and territories were added to the resulting Autonomous Region of Muslim Mindanao (ARMM) through a series of plebiscites or referendums in 1989, 2001, 2002 and 2006.

MILF commanders later laid claim to a further 712 villages outside the ARMM.

Negotiations between the government and the MILF began in earnest in June 2001. Both parties were to formally sign the resulting MOA-AD on Aug. 5, a deal which could have led to the creation of the separate Bangsamoro Juridical Entity, or fully-functioning state, replacing the ARMM by 2010.

When details of the agreement were leaked to the press, however, Christian politicians in regions of Mindanao affected by the agreement appealed to the Supreme Court, which in turn issued a temporary restraining order on the signing of the agreement on Aug. 4.
