The Greens have imposed a partial exclusion from their partyroom on radical New South Wales senator Lee Rhiannon, after her behaviour over the schools legislation.

Her colleagues were angry that she authorised a leaflet urging people to lobby senators to vote against the bill, on which the Greens were negotiating with the government. The nine other Green MPs wrote to the party’s national council about her conduct.

While the letter cited the leaflet, the concern about Rhiannon went further. Party sources said they had not been informed that she had been bound by the party’s NSW branch to oppose the legislation. Eventually all Green senators voted against the bill, after the government did a deal with ten other crossbenchers.

The issues with Rhiannon involved trust in her and the ability of the hardline NSW branch to bind MPs – a power it is accorded under the party’s federal constitution.

At a marathon meeting of more than four hours in Melbourne on Wednesday, it was decided that the structural problem needed to be resolved.

The partyroom asked the national council to work with Greens NSW “to end the practice of NSW MPs being bound to vote against the decision of the Australian Greens partyroom”.

This was supported by all MPs except Rhiannon.

The partyroom also passed a motion “that NSW senators be excluded from partyroom discussions and decisions on contentious government legislation, including within their portfolio responsibilities, until these issues are resolved”. At present Rhiannon is the only NSW senator.

Rhiannon and Adam Bandt, the Greens’ only lower house member, voted against the motion.

In a statement after the meeting, acting whip Nick McKim said: “To function as a national partyroom, and to be a genuine alternative to politics as usual, we need to have faith and trust in our processes.”

The ConversationThere is some uncertainty about how a battle with the NSW branch – controlled by the “watermelon” faction, a description reflecting its hard left position – will play out. Some in the party fear the situation could be inflamed, while others will welcome the branch being finally taken on.

Burma’s Ethnic Christians Fear Bleak Future after Election


Military hostilities against insurgents may result in Christian casualties and persecution.

CHIANG MAI, Thailand, October 22 (CDN) — With Burma’s first election in over 20 years just two weeks away, Christians in ethnic minority states fear that afterward the military regime will try to “cleanse” the areas of Christianity, sources said.

The Burmese junta is showing restraint to woo voters in favor of its proxy party, the Union Solidarity and Development Party (USDP), but it is expected to launch a military offensive on insurgents in ethnic minority states after the Nov. 7 election, Burma watchers warned.

When Burma Army personnel attack, they do not discriminate between insurgents and unarmed residents, said a representative of the pro-democracy Free Burma Rangers relief aid group in Chiang Mai, close to the Thai-Burma border. There is a large Christian population in Burma’s Kachin, Karen and Karenni states along the border that falls under the military’s target zone. Most of the slightly more than 2 million Christians in Burma (also called Myanmar) reside along the country’s border with Thailand, China and India.

The military seems to be preparing its air force for an offensive, said Aung Zaw, editor of the Chiang Mai-based magazine Irrawaddy, which covers Burma. The Burmese Air Force (BAF) bought 50 Mi-24 helicopters and 12 Mi-2 armored transport helicopters from Russia in September, added Zaw, a Buddhist.

Irrawaddy reported that the BAF had procured combat-equipped helicopters for the first time in its history. Air strikes will be conducted “most likely in Burma’s ethnic areas, where dozens of armed groups still exert control,” the magazine reported, quoting BAF sources.

“Armed conflicts between ethnic armies and the military can flare up any time,” said Zaw. “However, to boost the morale of its personnel, the military is expected to attack smaller ethnic groups first, and then the more powerful ones.”

Seven states of Burma have armed and unarmed groups demanding independence or autonomy from the regime: Shan, Karenni (also known as Kayah), Karen, Mon, Chin, Kachin, and Arakan (also Rakhine).

The junta has designated many areas in this region as “Black Zones” – entirely controlled by armed ethnic groups – and “Brown Zones,” where the military has partial control, said the source from FBR, which provides relief to internally displaced people in states across the Thai-Burma border.

“There are many unarmed Christian residents in these zones where Burmese military personnel attack and kill anyone on sight,” the source said.

A Karen state native in Chiang Mai who identified himself only as Pastor Joseph, who fled Burma as a child, referred to the junta’s clandestine campaign to wipe out Christians from the country. At least four years ago a secret memo circulated in Karen state, “Program to Destroy the Christian Religion in Burma,” that carried “point by point instructions on how to drive Christians out of the state,” reported the British daily Telegraph on Jan. 21, 2007.

“The text, which opens with the line, ‘There shall be no home where the Christian religion is practiced,’ calls for anyone caught evangelizing to be imprisoned,” the Telegraph reported. “It advises: ‘The Christian religion is very gentle – identify and utilize its weakness.’”

Persecution of Christians in Burma “is part of a wider campaign by the regime, also targeted at ethnic minority tribes, to create a uniform society in which the race and language is Burmese and the only accepted religion is Buddhism,” the daily noted.

The junta perceives all Christians in ethnic minority states as insurgents, according to the FBR. Three months ago, Burma Army’s Light Infantry Battalions 370 and 361 attacked a Christian village in Karen state, according to the FBR. In Tha Dah Der village on July 23, army personnel burned all houses, one of the state’s biggest churches – which was also a school – and all livestock and cattle, reported the FBR.

More than 900 people fled to save their lives.

 

Vague Religious Freedom

The Burmese regime projects that close to 70 percent of the country’s population is ethnic Burman. Ethnic minorities dispute the claim, saying the figure is inflated to make a case for Burman Buddhist nationalism.

The new constitution, which will come into force with the first session of parliament after the election, was passed through a referendum in May 2008 that was allegedly rigged. It provides for religious freedom but also empowers the military to curb it under various pretexts.

Article 34 states, “Every citizen is equally entitled to freedom of conscience and the right to freely profess and practice religion subject to public order, morality or health and to the other provisions of this Constitution.” Article 360 (a), however, says this freedom “shall not include any economic, financial, political or other secular activities that may be associated with religious practice,” apparently to bar religious groups from any lobbying or advocacy.

Further, Article 360 (b) goes on to say that the freedom “shall not debar the Union from enacting law for the purpose of public welfare and reform.”

Adds Article 364: “The abuse of religion for political purposes is forbidden. Moreover, any act which is intended or is likely to promote feelings of hatred, enmity or discord between racial or religious communities or sects is contrary to this Constitution. A law may be promulgated to punish such activity.”

Furthermore, Article 382 empowers “the Defense Forces personnel or members of the armed forces responsible to carry out peace and security” to “restrict or revoke” fundamental rights.

The Burmese junta is expected to remain at the helm of affairs after the election. The 2008 constitution reserves one-fourth of all seats in national as well as regional assemblies for military personnel.

A majority of people in Burma are not happy with the military’s USDP party, and military generals are expected to twist the results in its favor, said Htet Aung, chief election reporter at Irrawaddy.

Khonumtung News Group, an independent Burmese agency, reported on Oct. 2 that most educated young Burmese from Chin state were “disgusted” with the planned election, “which they believe to be a sham and not likely to be free and fair.”

They “are crossing the border to Mizoram in the northeast state of India from Chin state and Sagaing division to avoid participating,” Khonumtung reported. “On a regular basis at least five to 10 youths are crossing the border daily to avoid voting. If they stay in Burma, they will be coerced to cast votes.”

There is “utter confusion” among people, and they do not know if they should vote or not, said Aung of Irrawaddy. While the second largest party, the National Unity Party, is pro-military, there are few pro-democracy and ethnic minority parties.

“Many of the pro-democracy and ethnic minority candidates have little or no experience in politics,” Aung said. “All those who had some experience have been in jail as political prisoners for years.”

In some ethnic minority states, the USDP might face an embarrassing defeat. And this can deepen the military’s hostility towards minorities, including Christians, after the election, added Aung.

For now, an uneasy calm prevails in the Thai-Burma border region where most ethnic Christians live.

EU Visit to Orissa, India Triggers Barrage of Accusations


Hindu nationalists protest delegation as Christians cite injustices.

NEW DELHI, February 8 (CDN) — A delegation from the European Union concluded a “fruitful” trip to India’s violence-torn Orissa state on Friday (Feb. 5) amid a swirl of protests by Hindu nationalist groups and cries of injustice by Christians.

The delegation was able to hold “open and frank” discussions with Kandhamal officials on the visit, said Gabriele Annis of the Embassy of Italy.

“We had a very good meeting with the Kandhamal district administration,” Annis told reporters. “It is fruitful. We had open and frank discussion. It helped us in understanding the situation and understanding happenings over the past 15 months.”

The delegation was led by Christophe Manet, head of Political Affairs of the European Commission delegation to India and consisted of members from Spain, Hungary, Poland, Ireland, Italy, Netherlands, the United Kingdom, Finland and Sweden. A delegation from five European countries had visited Orissa earlier in November 2009, but the government of Orissa denied them permission to visit Kandhamal district, where Christians say they continue to be threatened and destitute.

Archbishop Raphael Cheenath said on Saturday (Feb. 6) that despite the claims of the state and district administrations, life for the Christian victims of violence in August-September 2008 remains far from normal: thousands still live in makeshift shanties along roadsides and in forests, he said, and local officials and police harass them daily.

“The block officers have been playing with the facts, indulging in corrupt practices and cosmetic exercises whenever political and other dignitaries come to visit or inspect,” the archbishop said in a statement. “Innocent people are coerced into giving a false picture. The chief minister must investigate the role and functioning of the entire district administration . . . It is strange that officers in whose presence the violence took place and thousands of houses were burnt are still in office and are declaring that there is peace in the district.”

Following attacks in the area after Hindu extremists stirred up mobs by falsely accusing Christians of killing Hindu leader Swami Laxmanananda Saraswati on Aug. 23, 2008, more than 10,000 families were displaced from their homes by the violence. Since then, Cheenath said, an estimated 1,200 families have left the area. Between 200 and 300 families reside in private displacement camps in the district, and more than 4,400 families still live in tents, makeshift shelters or the remnants of their damaged houses, he said.

The number of attack victims who have received financial assistance from the government, churches or Non-Governmental Organizations (NGOs) is unknown, but is estimated at 1,100 families, Cheenath added.

He criticized Prime Minister Manmohan Singh and the Chief Minister of Orissa Naveen Patnaik saying, “Both of them had promised to provide adequate compensation for the damages caused during the 2008 communal violence. But the victims have not been adequately compensated.”

Cheenath said the state government had decided not to compensate any riot-affected religious institutions even though India’s Supreme Court had directed the government to compensate them for all damages.

“This is a national calamity and demands a special package for the affected people, which should include land, income generation, education and healthcare,” the archbishop said.

Extremist Makeover

Prior to the visit, Christian leaders expressed their shock at Kandhamal district authorities attempting a cosmetic makeover by evacuating nearly 100 Christians from G. Udayagiri.

In letters to the EU delegation, the state government and national human rights and minorities commissions, Dr. John Dayal of the All India Christian Council narrated the plight of the 91 members of 21 families from 11 villages who were living under plastic sheets along a road in the marketplace area of G. Udayagiri.

Dayal said the group included 11 married women, three widows, an elderly man with a fractured hip and thigh, and two infants born in the camp. They had faced almost daily threats, he said, as they had not been allowed to return to their villages unless they renounced their faith and became Hindus.

Soon after the decision to allow the EU delegation, the water supply to the makeshift site was cut off and police and civil officers drove away the residents, who had only plastic sheets to protect them from the cold, he said. The refugees said officers later gave them permission to come back at night but to keep the area clear.

“The families are in G. Udayagiri, they have moved in front of the road, and they are in a very bad state,” the Rev. Samant Nayak of G. Udayagiri told Compass. “They are literally on the road.”

He said that approximately 55 families were living in G. Udayagiri, where they had been given land, and a Christian NGO was helping to construct houses for them.

The Press Trust of India reported that Orissa officials were nervous about last week’s delegation visiting Kandhamal but finally gave permission under pressure from the central government. State officials finally allowed the visit with the pre-condition that the delegation would be allowed only to interact with people and not engage in fact-finding, according to a senior official in Orissa’s home department.

The Kandhamal district collector, Krishna Kumar, told Compass that all went well and “no untoward incidents took place,” but sources reported at least one minor disturbance in Bodimunda village. On Wednesday (Feb. 3), one house was reportedly damaged there in a scuffle that also resulted in two arrests by the local police.

During their Kandhamal visit, the EU delegation was reportedly forced to cancel a meeting with judges of Fast Track courts established in Phulbani, in Kandhamal district, to prosecute hundreds of those accused in the 2008 violence, due to protests from the local lawyers’ association.

Kumar, however, pointed out that the lawyers’ protest was secondary to the lack of clearance from the High court for the meeting with the judges. “The same was not informed to us prior to the visit,” he added.

Justice Denied

The anti-Christian violence in August-September 2008 killed over 100 people and burned 4,640 houses, 252 churches and 13 educational institutions. Archbishop Cheenath said justice is critical to long term peace.

“The two Fast Track courts, and the court premises, have seen a travesty of justice,” he said in the Feb. 6 statement. “Witnesses are being coerced, threatened, cajoled and sought to be bribed by murderers and arsonists facing trial. The court premises are full of top activists of fundamentalist organizations. The witnesses are also threatened in their homes with elimination, and even their distant relatives are being coerced specially in the murder and arson cases against Member of Legislative Assembly [MLA] Manoj Pradhan.”

Though some witnesses have testified on Pradhan’s alleged involvement in crimes in depositions, he has been acquitted in case after case, the archbishop added.

“We are demanding a special investigation team to investigate every case of murder and arson,” he said. “Similarly, there is also need for transferring the cases against politically powerful persons such as Pradhan to outside Kandhamal, preferably to Cuttack or Bhubaneswar.”

Cheenath said victims have filed 3,232 complaints at Kandhamal police stations, but officers registered only 832 cases. As many as 341 cases were in the G. Udayagiri area alone, 98 in Tikabali and 90 in Raikia, he said.

“Even out of this small number [in G. Udayagiri], only 123 cases were transferred to the two Fast Track courts,” he said. “So far, 71 cases have been tried in the two courts, and 63 cases have been disposed of. Of these, conviction occurred only in 25 cases, and even that is partial as most of the accused have not been arrested or brought to trial.”

Only 89 persons have been convicted so far in Orissa state, while 251 have been acquitted, supposedly for lack of witnesses against them, he said.

“Among them is Manoj Pradhan,” Cheenath said. “It is strange that in the case of 10 deaths by murder, nine cases have been closed without anybody being convicted, while there has been partial conviction in the case of one death. Who will bring justice in the case of the nine murder cases?”

The archbishop demanded that independent lawyers be allowed to assist overworked special public prosecutors.

Hindu Nationalist Protests

Protesting the delegation visit was the Vishwa Hindu Parishad (VHP) and other Hindu nationalist organizations. VHP State General Secretary Gouri Prasad Brahma had lamented on Jan. 31 that the visit would trigger tension and demanded their immediate withdrawal.

“There is no business of the outsiders in the internal matter of the state,” he said.

The delegation also faced the ire of the Hindu extremist Bajrang Dal on the day of its arrival in Bhubaneswar, capital of Orissa, on Tuesday (Feb. 2). Hundreds of its cadres met the delegation at the airport shouting loudly, “EU team, go back.”

Five Bajrang Dal members were detained for creating trouble, Deputy Commissioner of Police H.K. Lal told media on Wednesday (Feb. 3).

After the delegation had left, the Orissa Bharatiya Janata Party (BJP) heavily criticized the central and the state governments, with BJP state President, Jual Oram telling a press conference that the state had allowed the visit to “divide people on communal lines.” He said that the delegation had not met any Hindu leader during their visit to Kandhamal, which “exposed their communal agenda.”

Oram accused the delegation of violating protocol in trying to meet the judges of fast-track courts in Kandhamal, saying this “amounted to interference into internal affairs of a sovereign independent member state under the U.N.”

At the same press conference, BJP MLA Karendra Majhi said that allowing the visit was an attempt by the chief minister to win back the confidence of minority Christians. He alleged that the delegation had held secret meetings in a Catholic church at Phulbani with church leaders and select NGOs to facilitate conversions to Christianity.

“I have every reason to believe that the promised assistance of 15 million euros to Kandhamal by the EU delegation will be utilized for conversion activities,” Majhi said.

Christians in India Faced Three Attacks per Week in 2009


Over 150 assaults reported, many in southern part of country.

NEW DELHI, December 31 (CDN) — After unprecedented large-scale attacks on Christians in the previous two years, 2009 brought hardly any respite as the minority faith faced an average of more than three violent attacks a week.

There were at least 152 attacks on Christians in 2009, according to the “Partial List of Major Incidents of Anti-Christian Violence in India” released by the Evangelical Fellowship of India.

“The trend of attacks on the Christian community by rightwing Hindu groups goes unabated,” said Dr. Dominic Emmanuel, the spokesperson of the Delhi Catholic Archdiocese. “Overall, the Christian community still feels insecure.”

Emmanuel also noted that none of the states that have “anti-conversion” laws have repealed them. The north-central states of Madhya Pradesh and Chhattisgarh, Orissa in the east, Gujarat in the west and Himachal Pradesh in the north have anti-conversion laws, which Hindu hardliners routinely use to arrest Christians on spurious accusations of “forcible conversion.”

“If 2007 and 2008 went down in history as the most blood-soaked ones in the history of modern Christianity in India, 2009 surely rates as the year of frustrating confrontations with the law and tardy governance and on justice for the victims of communal violence,” said Dr. John Dayal, a Christian and human rights activist and member of the government’s National Integration Council.

Dayal referred to violence that erupted in Orissa’s Kandhamal district during the Christmas week in 2007, killing at least four Christians and burning 730 houses and 95 churches. The attacks were carried out to avenge an alleged attack on a Vishwa Hindu Parishad (World Hindu Council or VHP) leader, Swami Laxmanananda Saraswati.

Violence re-erupted in Kandhamal in August 2008 after the assassination of Saraswati by a Maoist group, as rightwing Hindu groups falsely blamed Christians for it. This time, the violence killed more than 100 people and resulted in the incineration of 4,640 houses, 252 churches and 13 educational institutions.

No Longer a Haven

A disturbing new trend emerged this year as southern India, which had long been considered a haven for Christians, recorded the highest incidence of anti-Christian violence. Of the total 152 incidents, 86 were reported from southern states, mainly Karnataka with 48, Andhra Pradesh with 29, Tamil Nadu with five and Kerala with four.

Northern and central states, seen as the stronghold of rightwing Hindu extremists, recorded 42 incidents of violence, half the number in the south.

There were 15 attacks in Madhya Pradesh state, 14 in neighboring Chhattisgarh, three each in Uttar Pradesh and the Himalayan states of Himachal Pradesh and Jammu and Kashmir, and one each in the national capital Delhi and neighboring Haryana state.

In the west, seven attacks were reported: six in Maharashtra and one in Gujarat. In the northeast, four attacks were reported: three in Assam and one in Manipur.

Karnataka recorded the highest number of violent incidents as the first-ever victory of the Hindu nationalist Bharatiya Janata Party (BJP) in the state elections in 2007 emboldened rightwing Hindu extremist groups. Karnataka became the first southern state with a stand-alone BJP government in the history of India.

Anti-Christian violence in Andhra Pradesh rose to new heights after a Christian, Y.S. Rajasekhara Reddy, became the chief minister of the state in May 2004. To target him politically, rightwing Hindu groups attacked Christians while accusing them of converting Hindus to Christianity. This year Reddy died on Sept. 2 in a helicopter crash.

The incidence of Christian persecution in the north and the central states declined apparently due to the BJP’s defeat in the April-May general elections and a growing realization among a section of the BJP leadership that violent incidents no longer please voters. But the hard-line section of the BJP and groups linked to the party, such as the VHP and its youth wing Bajrang Dal, carried on with their hardcore anti-Christian stand.

Impunity in Orissa

Orissa state in the east, which witnessed two massive spates of attacks on Christians in 2007 and 2008, saw only two recorded violent incidents this year.

The morale of Christians in Orissa, however, remained low as few assailants in the 2008 rampage were brought to justice.

“The courts in Kandhamal make a mockery of the judicial process, and the murderers lord it over the witnesses and victims while judges and law look on,” Dayal said. “The church remains helpless, its puny effort at giving strength to the witnesses falling far too short.”

Of 787 cases registered by Orissa police, 100 are being handled by two-fast track courts in Kandhamal. Around 35 cases have been heard, resulting in around 50 convictions and more than 190 acquittals.  Manoj Pradhan, a legislator for the BJP, has been exonerated “for lack of evidence” in six cases, most of them involving murder charges.

Dr. Sajan K. George, national president of the Global Council of Indian Christians, said the growing number of acquittals was producing a culture of impunity, “where those who commit crimes against Christian minority do not fear punishment by law.”

“As the elected representative of the Orissa state assembly [Pradhan] has been let off in murder cases,” George said. “People want to know what has happened to the long arms of justice.”

Dayal, who was in Kandhamal recently, said that of the more than 4,640 houses burned in 2008 violence, only 200 have a roof over the rebuilt walls as 2009 ends.

“And perhaps at the end of the next year, another 2,500, God willing, will have been rebuilt,” he said. “But around 2,000 houses will even then remain unfinished.”

Dayal added that more than 20,000 men, women and children of Kandhamal continue to live as refugees or homeless people in various cities, working at odd jobs and sometimes begging.

“Some girls have already been pushed into the evil of human trafficking,” he said.

Most people in Kandhamal remain without jobs, and the rehabilitation process, in which the church is participating, still is a long distance from covering all victims, Dayal said, adding, “The state government seems to have called it a day with the barest minimum done in this sector.”

Emmanuel of the Delhi Archdiocese said that since the BJP is not in power at the federal level, some of their front organizations such as the Rashtriya Swayamsevak Sangh, the VHP and the Bajrang Dal will harass Christians in order to remain in the news.

“Christianity teaches us to hope in God,” Emmanuel said. “We can only hope that 2010 will be a better year for Christians, but in practical terms it really does not appear that things would be any better as the ranks of rightwing Hindu fundamentalists keep their pressure.”

There are around 24 million Christians in India, or roughly 2.3 percent of the over 1.1 billion people.

ISRAEL: NON-ARAB CHRISTIANS SEEK IN VAIN FOR BURIAL SITES


Orthodox denominations face discrimination from authorities, nominally Christian gatekeepers.

HAIFA, Israel, July 8 (Compass Direct News) – Here in Israel’s third-largest city, it was not possible for the Russian Orthodox relatives of a 65-year-old woman who died on June 27 to find a Christian cemetery for her.

Their plight – for five days the body of Nadejda Edelman was stored at a hospital morgue – is common to Christians of foreign ancestry throughout the country. When Edelman passed away in Rambam Medical Center in this northern Israeli city, it took almost a week to find a grave for her and arrange for a funeral. Haifa, with 265,000 people, is 90 kilometers (56 miles) north of Tel Aviv.

On July 1 Edelman, a devout Christian, was buried outside of Haifa in Emeq Hefer Local Council Cemetery – a “secular” site for persons of no faith tradition. Had there been a Christian cemetery available, Edelman’s family might still have had problems obtaining a plot; the immigrant had not been able to have her ID registered as “Christian,” only as “Russian.”

“A cross on her neck and a testimony on her behalf by her close friend, as Edelman was childless, didn’t convince the authorities, and even if it would have, there are just no existing solutions for the deceased Russian Orthodox Christians of Russian origin in Israel,” said one of the founders of Sophia, an association of Russian Orthodox Christians in northern Israel. He requested anonymity.

Throughout Israel it’s not unusual for delays of days or weeks for burial of the Christian deceased of foreign ancestry. One Christian, Sergei Loper, was not buried until 20 days after his death; for another, Yuri Neverdasov, an available grave was not found for five days.

Christians make up 2.1 percent of Israel’s population, and the Orthodox denominations are a fraction of that. The issue of funeral rites and burials in Israel is especially difficult for these minorities, given the country’s complicated ethnic and religious makeup and laws that give religious institutions control over personal matters such as weddings, births and deaths.

The faith communities of Jews and Arabs in Israel each have their own designated burial societies that are responsible for arranging burials as well as religious rituals. Jewish burial societies called Hevra Kadisha are responsible for the Jewish deceased, while Arab burial societies provide services for Arab Muslims and Christians.

Such societies must obtain a special permit from the Ministry of Religious Affairs and sign a contract with the Social Security Service; this latter agency then covers the cost of burial fees in accordance with Israeli law. In theory every family in Israel is entitled to this reimbursement, but Russian Orthodox and Greek Orthodox families miss out because the funds go to the Arab burial societies rather than directly to the survivors.

Problems in addressing foreigners’ needs began in the early 1990s with a massive wave of immigration from the Former Soviet Union. Along with Jewish relatives, many Christians, Muslims and non-religious emigrants from Russia settled in Israel. Soon authorities were hard-pressed to address the needs of children of mixed marriages and of non-Jewish spouses and relatives – some with religious backgrounds other than Judaism, some holding no defined religious views and some who were atheists.

The question of foreign (especially Russian) Christians, as well as that of Jews who openly declared their conversion to Christianity, was especially disturbing, and Israel initially dealt with it by registering many people only as “Russians” without any reference to their religious belief. Later the religious designation for all people was eliminated from Israeli identification cards.

With legislation that was passed in 1992 but took more than a decade to implement, eventually authorities worked out a partial solution – establishing a few secular cemeteries and creating sections within Jewish cemeteries for “non-religious persons.” These measures did not meet the needs of people who wished to be buried in accordance with their religious beliefs, especially the Russian Orthodox and Greek Orthodox Christians.

Discrimination against Non-Arabs

The Sophia association has tried to address this complicated issue and assist members of the Russian Orthodox community and their families. Thus far authorities have little heeded their plea.

“It would be only natural if Christians would be buried in Christian cemeteries, yet the Arab local councils usually decline our requests,” said Dr. Ilya Litvin of Haifa, a member of Sophia.

In Israel’s Arab Christian cemeteries, the heads of local councils are the only ones entitled to make the decisions, but many of them are Christians by birth only; they belong to Communist parties and in reality have little sympathy for religious sentiment, advocates said.

“They claim that there is a severe shortage of graves there and little possibility for expansion, yet I believe that it’s just politics,” Litvin said. “They don’t really care about us – we are not Arabs.”

Oleg Usenkov, press-secretary of St. Nicolay’s church at Migdal ha-Emeq, added that a Christian burial may sometimes come only as a negotiated favor.

“Sometimes our priest, Father Roman Radwan, pulls personal connections and after some negotiations they allocate a grave for the deceased members of our community, but usually we hear a ‘No,’” he said.

Other options for the church are the non-Jewish section at the Jewish cemetery or the secular cemetery. It is usually not possible, however, to conduct Christian ceremonies at these sites.

Usenkov of St. Nicolay’s church said he vividly recalls a recent funeral of his friend Andrey Shelkov.

“The funeral was organized by the Jerusalemite Hevra Kadisha [Jewish burial society], and we were not even allowed to put a cross inside the coffin,” Usenkov said. “One of the Hevra Kadisha workers felt sorry for us and told me, ‘You can draw a Pisces [fish symbol] on his arm and put it inside the coffin, isn’t that a Christian symbol as well?’ Imagine that: having to draw a Pisces, just like the early Christians who had to hide their faith!”

Burials can be costly, and the Israeli Social Security Service covers burial fees only by transferring the compensation to the burial societies, not to the families of the deceased. Since there is no such burial society for Russian Orthodox Christians, state funds to cover the high costs go to local councils’ treasuries rather than to the families.

The leaders of Sophia have requested the office of Israel’s prime minister to give their association status similar to that of a Hevra Kadisha, which would allow Sophia to meet the burial needs of Russian Orthodox and Greek Orthodox Christians, but to no avail.

“In reply we received a formal letter which offers no solution,” said Litvin. “The letter suggested that we should somehow obtain a cemetery, and that then we were to apply to the Ministry of Religious Affairs for the license – which is practically impossible, and everyone knows it.”

A written inquiry by Compass to the social security office elicited the same response.

“We feel helpless and frustrated: the heads of Greek Orthodox Church choose not to interfere, or maybe they can’t, while the Israeli authorities are brushing us off,” Litvin said. “As a result, innocent people are denied of their basic right – to be buried according to their religious beliefs. Some of them are childless and poor, and there is no one to stand up for their rights. We hope that someone will take responsibility for this issue.”

PAKISTAN: POLICEMAN TORTURES, PARALYZES CHRISTIAN


Disabled Christian waits in 9-year legal limbo, sent to prison for ‘kidnapping.’

ISTANBUL, December 23 (Compass Direct News) – A Pakistani Christian boy’s quarrel with a Muslim policeman’s son has led to his father’s imprisonment, torture, paralysis, and five-year prison sentence.

The father’s health condition has become so fragile that he was temporarily released from prison and sent to a Faisalabad hospital on Sunday (Dec. 21). Emanuel Masih, 43, is now in stable condition, his attorney told Compass.

Masih, of Faisalabad, a father of six and a former street sweeper, is trying to commute his prison sentence after police officer Omer Draz tortured him and had him imprisoned on trumped-up charges originating from a quarrel between their sons nine years ago.

The situation began in 1999 when his son Saleem, 9 at the time, was involved in a dispute with Draz’s son at the childrens’ Muslim-majority elementary school. The next day to protect Saleem, Emanuel Masih and his brother-in-law Amin Masih accompanied Saleem to a bus station, along with Saleem’s brothers, to subdue the police officer. Draz, however, attacked Saleem and Emanuel Masih’s other sons.

Following the incident Draz conspired with his housecleaner Zaniran Bibi, a Christian, to have Emanuel Masih arrested. She claimed that Emanuel Masih was responsible for the kidnapping of her son, who had gone missing some time earlier.

There was no evidence to link Emanuel Masih to the kidnapping, his attorney said.

Police arrested Emanuel Masih along with Amin Masih, who was also falsely implicated in the kidnapping, without possibility of bail. The two men were tortured for a month, according to a report from the Centre for Legal Aid Assistance and Settlement (CLAAS) advocacy group.

Draz had a regular routine of torture for Emanuel Masih and his brother-in-law: He gathered them together, dragged them outside the police station and beat them with iron rods. A month of these beatings paralyzed Emanuel Masih’s arms and legs.

“They took (them) to a private house and beat them there,” said CLAAS lawyer Akbar Durrani to Compass. “They used a separate house because they are afraid of the courts.”

Emanuel Masih was then sent to judicial lock-up since he was too weak to attend a court hearing. The prison superintendent was so surprised at his condition he called on Emanuel Masih’s younger brother, Jabar Masih, to provide him physical care.

Emanuel Masih is also illiterate. Due to his injuries he could not work and had to rely on donations from charity groups. He has regained partial use of his legs but still cannot use his arms. He has been unemployed since 1999.

The two men were eventually released on bail. In the intervening nine years, Emanuel Masih and Amin Masih continued to attend court hearings. But on May 24 they were arrested and given a five-year prison sentence along with a fine of 25,000 rupees (US$320). Lawyers appealed the decision in September at a Faisalabad court.

 

Trying to get out

Emanuel Masih could be released from prison due to an article in Pakistan criminal law that requires proper facilities for an incapacitated person. If they are not available the prisoner can be released without a court order.

In September Durrani filed a petition of release to Pakistani Home Secretary Madhukar Gupta, who is in charge of the country’s internal security. Without the use of his arms, Emanuel Masih could not survive in prison unless Amin assisted him.

“His brother-in-law feeds and washes him,” Durrani said. “That’s why he has been able to survive until now.” 

Gupta requested a medical examination of Emanuel Masih, which declared him incapacitated. The final decision to let him go rests with the jail superintendent, who received the report from the home secretary in early December.

Faisalabad is located in Punjab, near the Indian border. Radical religious elements in Punjab have become active in carrying out Islamic terrorist acts outside Pakistani borders. Two of the nine identified gunmen in the Nov. 26 attacks in Mumbai that killed 188 and injured 293 were from this city of 2.6 million.

On Wednesday, Dec. 17, Muslims set fire to a church in a nearby village as its parishioners were decorating for Christmas. The attackers left behind a letter telling the Christians they would be damned to hell if they did not become Muslims, according to International Christian Concern.

Parish priest Yaqoob Yousaf has called for security forces to arrest the culprits quickly, for fear of similar attacks on the congregation during its Christmas Day services.
