Is bottom-pinching still ‘indecent’ by today’s community standards?

In a recent court case in Western Australia, Magistrate Michelle Ridley ruled that “in an era of twerking” and easy access to pornography, it was not an indecent assault when a police officer pinched a woman’s backside.

Here’s what happened. In December 2017, 48-year-old police officer of 17 years, Andrew Ramsden, participated in a yearly wheelchair basketball charity event. After the game, the anonymous complainant asked if she could have a “serious photo” with other members of the police team.

But when posing for the photo, Ramsden thought it would be funny to startle her by pinching her buttocks, and she jumped forward in surprise when he did so. Ramsden reportedly then said to her either “I hope you take this the right way” or “don’t take this the wrong way”.

He was charged with “unlawfully and indecently assaulting another person” under section 323 of the Criminal Code (WA). And he was eventually found not guilty.

But twerking, grinding, and the easy availability of pornography should never be an excuse for sexual harassment. This argument effectively shifts the blame on victims and implies that the sexualisation of society means women consent to being sexually harassed, which is far from the truth.

And in the era of the #MeToo movement, where women are holding men to account for sexual harassment, it seems the court in the Ramsden case hasn’t caught up to this wider cultural shift.

What is considered ‘indecent’?

Determining if an act is “indecent” requires considering the intention of the accused.

The courts have stated for an assault to be indecent there

must be a sexual connotation to the activity. It must be an activity which offends community standards of propriety prevailing at the relevant time.

In Ramsden’s case, the magistrate held that the act was not indecent because it was not done for a sexual purpose. And the WA Supreme Court recently upheld the magistrate’s decision, and acquitted him.

The magistrate and the Supreme Court rejected the prosecution’s argument:

the prevailing standards of the community today are that any touching by a man of the buttocks of a woman is inherently indecent.

It has never been okay

Determining community standards is best left to a jury rather than a single judge or magistrate to help ensure “the application of the law is fair and consistent with community standards”. However, no jury was used in Ramsden’s case, so it was up to the magistrate alone to decide whether today’s community would regard pinching a person’s bottom as indecent.

Magistrate Ridley said in the 1970s and 1980s, “a pinch on the bottom was naughty and seen as overtly sexual and inappropriate for that time”. But added nowadays “the thought of a pinch on the bottom is almost a reference to a more genteel time”.

Magistrate Ridley believed pinching a person’s backside lost its overtly sexual connotation “in an era of twerking and grinding, simulated sex and easy access to pornography”.

But it wasn’t okay to touch people inappropriately then, and it still isn’t now.

The worldwide #MeToo movement, which the prosecution referred to in the trial, is just one example showing the significant cultural shift in societal views of sexual harassment.

On appeal, the Supreme Court accepted the movement had led to an

increase in the number of complaints by women and to increase awareness of the unacceptability of such acts and conduct.

However, it held that no evidence was put forward to the magistrate

upon which a finding could be made that the effect of the movement itself had resulted in a change in community standards as to the ‘acts’ and ‘conduct’ that should, at law, be deemed ‘indecent’.

Cultural change takes time. The #MeToo movement is a positive step in changing how we respond to sexual assault. Implying pornography and dancing excuses sexual harassment is a step backwards.

University of Technology Sydney criminal law lecturer Dr Katherine Fallah criticised the Ramsden decision. In an interview on Triple J, Fallah made an excellent point, arguing:

The statement about twerking and about porn are offered in a fairly derisory way of talking about things that are very remote from the facts of the case – here we have a woman having a photo taken after … a wheelchair basketball charity event.

The bottom line

A person’s backside is an intimate part of one’s body and no one should have to tolerate unwanted contact of their private parts for someone else’s amusement.

The Ramsden case fails to reinforce this message because of the definition of “indecency”, which requires a sexual motive for the act.

Australian legislators need to step in and make it clear that deliberately pinching a person’s backside is a form of sexual harassment. Without consent, such conduct is unacceptable, regardless of whether it is done for a sexual purpose or in a poor attempt at humour.

The bottom line is that “bum pinching isn’t — and has never been OK”.The Conversation

No Don Burke, there is no link between autism and harassing behaviour

Allegations that Don Burke indecently assaulted and bullied staff during his time hosting Burke’s Backyard were heinous enough. But in an interview with A Current Affair last night, he created another victim: the autism community.

In the interview, Burke claimed that he has Asperger’s syndrome:

I haven’t been medically diagnosed but I’ve worked it out, what it is, and it’s a terrible failing.

I have difficulty looking anyone in the eye. I can look in the lense, but I have real difficulty looking anyone in the eye … it’s a typical thing. And I miss all their body language and often the subtle signs that people give to you like, ‘Back off, that’s enough’, I don’t see that.

I suffer from a terrible problem with that, of not seeing … and no-one can understand how you can’t see it. But you don’t.

In examining Burke’s comments, it’s helpful to separate “excuse” from “explanation”. It’s clear there is no excuse for humiliation, bullying and harassment. Nevertheless, reasonable explanations can still underlie inexcusable behaviour.

Burke sought to use Asperger’s syndrome as that explanation. Whether or not Burke would meet criteria for Asperger’s syndrome is not the issue. The problem is that the statements he made about Asperger’s syndrome are utterly false and have an impact far beyond his own circumstance.

Remind me, what is Asperger’s syndrome?

Asperger’s syndrome is part of the autism spectrum, and is characterised by difficulties with social interaction and communication.

Autism spectrum conditions are diagnosed by a team of clinical experts, often including a specially trained medical doctor, a psychologist and a speech pathologist. While autism is a heritable condition (it “runs” in families), we currently don’t know enough about the genetic factors underlying the condition and so we diagnose based on observable behaviours.

A defining characteristic of autism (and Asperger’s syndrome) is differences in social behaviours, such as difficulties initiating or maintaining social interaction with others. However, these social difficulties bear no relevance to a lack of empathy for others, which, of course, underlies bullying and harassing behaviour.

Empathy comes in two forms – cognitive empathy (ability to recognise others’ emotions), and emotional empathy (ability to feel others’ emotions once that emotion has been recognised). There is strong research evidence that some individuals with autism may have challenges with cognitive empathy, but no evidence for difficulties with emotional empathy.

In essence, once there is understanding of what a person is feeling, people on the autism spectrum are often intensely empathetic.

More likely to be bullied than a bully

While the behaviours that characterise autism can create challenges in day-to-day life, there is no link between autism and the perpetration of bullying and harassment. Indeed, dozens of scientific studies have investigated this, and all evidence indicates that people on the autism spectrum are far more likely to be the victims of these behaviours than the other way around.

Burke’s statements create real and lasting damage. There is considerable research evidence showing the stigma that still surrounds autism, and the detrimental effects that stigma can have on people with the condition and their families.

I think about the young man with Asperger’s syndrome, who has fostered enormous courage to attend and enjoy school, and now has another target placed on his back.

I think about parents of newly diagnosed children, who are met with yet another jarring myth to swirl around their tired and worried minds. I think about how this may affect their view of the years that lie ahead of them. These years will come with great challenges, but also the greatest of joys.

I think about employers, who are just starting to understand the vast talents and economic benefits people on the autism spectrum bring to their workplace, and how even the smallest seeds of doubt can be fertilised by the public airing of patently false statements.

I think about all of these people – the wonderful autism community – and how they would feel in being used as a punching bag yet again. The autism community frequently takes punches from media and public figures in an attempt to excuse or explain human behaviour.

The ConversationAustralia would do very well to not simply ignore Don Burke’s comments, but instead use the anger they generate to continue the path of cherishing and valuing the diversity that the autism community provides our society.

Church Buildings Attacked in Malaysia Following Court Decision


Muslim groups angered by ruling to allow Catholic newspaper to use word ‘Allah.’

KUALA LUMPUR, Malaysia, January 11 (CDN) — In unprecedented acts that stunned Christians in Malaysia, suspected Islamists have attacked eight church buildings since the country’s High Court ruled that a Catholic weekly could use the word “Allah.”

Firebombs were thrown into the compounds of four churches in Kuala Lumpur and neighboring Petaling Jaya on Friday (Jan. 8); three more attacks occurred on Sunday (Jan. 10) in Taiping, Melaka and Miri; and another church building was hit today in Seremban. There were no reports of injuries.

Judge Lau Bee Lan delivered the controversial court ruling on Dec. 31, arguing that the Herald had a constitutional right to use the word “Allah” for God in the Malay section of its multi-lingual newspaper. The ruling caused an uproar among many Muslim groups widely reported to have called for nationwide protests after Friday prayers, asserting that “Allah” can be used only in the context of Islam. Among groups calling for protests were the Muslim Youth Movement and the National Association of Muslim Students.

Inflammatory rhetoric has emerged in the escalating conflict; at a protest in Shah Alam since protests began on Friday, a speaker at one rally urged listeners to “burn churches,” according to the online news site Malaysian Insider. The crowd reportedly stood in stunned silence.

Malaysia’s Home Ministry filed an appeal against the High Court decision on Jan. 4. Two days later, the court allowed a freeze on the decision to permit the Herald to use the word “Allah” pending hearing in the Court of Appeal.

The attacked churches were Metro Tabernacle (Assembly of God) in Kuala Lumpur, and three churches in Petaling Jaya: Life Chapel (Brethren), Assumption Church (Catholic) and Good Shepherd Lutheran Church (Lutheran); also damaged were All Saints’ Church (Anglican) in Taiping, Melaka Baptist Church in Melaka (vandalized but not firebombed), Good Shepherd Church (Catholic) in Miri (pelted with stones) and Sidang Injil Borneo (Evangelical Church of Borneo) in Seremban.

Though there were no casualties, a number of the church buildings were damaged in the attacks. Metro Tabernacle suffered the worst damage, with the ground floor of its three-story building, which housed its administrative office, completely gutted. The main door of the church in Seremban was charred.

The Rev. Ong Sek Leang, senior pastor of Metro Tabernacle, reportedly said that the church harbors no ill feelings toward the culprits and would forgive those responsible, but that it does not condone the acts.

Most of the other church buildings suffered minor damage, though the Assumption Church was spared when the Molotov cocktail thrown into its compound failed to go off. The Melaka Baptist Church building was splashed with black paint, while stones were thrown into the Good Shepherd Church building in Miri.

The Malaysian Insider reported on Friday (Jan. 8) that two other churches received telephone threats from unknown sources.

Christian leaders, government and opposition leaders, and Non-Governmental Organizations have condemned the attacks. Police have promised to increase security around church buildings, but Inspector-General of Police Musa Hassan told the Malaysian Insider that churches must beef up their own security since there is a shortage of police personnel.

Malaysia’s population is about 60 percent Muslim, 19 percent Buddhist and 9 percent Christian. About 6 percent are Hindu, with 2.6 percent of the population adhering to Confucianism, Taoism and other traditional Chinese religions.

Shocked

The spate of church attacks shocked the Christian community and nation, as acts of violence on places of worship are unprecedented in Malaysia.

Ramon Navaratnam, Chairman of the Centre of Public Policy Studies, said in a press statement on Friday (Jan. 8) that the attacks marked a “troubling trend” and “a low point in our nation’s history.”

The same day, Malaysian Bar Council Chairman Ragunath Kesavan said in a press statement that the attacks were “shocking and offensive” and that “all right-minded Malaysians must condemn it as indecent and unacceptable.”

Christian leaders strongly denounced the attacks and have asked the government to safeguard the community and its places of worship. They have also called on the government to take firm steps against the perpetrators while paving the way for greater understanding between the different religious communities.

The Rev. Dr. Hermen Shastri, general secretary of the Council of Churches Malaysia, called on the government to “show zero tolerance for the use, threat or incitement, of violence as a means to pressure the decision of the court.” The Rev. Eu Hong Seng, chairman of the National Evangelical Christian Fellowship, called on the government “to take the necessary steps to educate those who lack understanding and are ‘easily confused’ to be mature-minded in a progressive democratic society.”

Leaders on both sides of the political divide have also denounced the attacks, while a number of opposition leaders – including Anwar Ibrahim, adviser to the People’s Justice Party – put the blame on the United Malay National Organization (UMNO), the leading partner in the ruling coalition government. Anwar reportedly accused UMNO-owned newspaper Utusan Malaysia of having incited Muslims over the court decision.

A number of local commentators have also criticized Prime Minister Najib Abdul Razak and Home Minister Hishammuddin Hussein for not defusing rising tensions in the initial days of the court ruling. They have also come under fire for saying they would allow public demonstrations by Muslim groups to proceed, and that they would take action “only if things got out of hand.”

Despite the attacks, a check with parishioners of several churches in the Klang Valley showed Christians were undeterred by the acts of violence and continued to gather for worship yesterday.

Urging Christians to pray, Sam Ang, secretary-general of the National Evangelical Christian Fellowship, told Compass, “We see this as an opportunity to trust in the Lord and to revitalize our faith, especially for second-generation Christians.”
