The plight of Afghan security contractors highlights the legal and moral risks of outsourcing war


Anna Powles, Massey UniversityBy first denying and then granting visas to more than 100 Afghan contractors who guarded its embassy in Kabul, Australia has shone a light on the murky world of the private security industry.

According to the lawyer and former army officer representing the security guards, his clients had yet to receive the humanitarian visas and the about-face was merely an attempt by Australian officials “to look like they have done their job when they sat on their hands for so long”.

The Australian case mirrors the British government’s policy reversal concerning 125 Afghan security guards at its Kabul embassy.

They, too, were initially informed they were ineligible for emergency evacuation due to being employed by Canadian private security firm GardaWorld, only for the decision to be overruled late last week.

In both cases, these Afghan contractors have fallen into the shady legal gap between the private security company that employed them locally and the governments that contracted their employers.

As one GardaWorld employee said when he was told his contract would be terminated:

No one asked whether we are safe or not. No one asked whether our lives are in danger or not.

Privatising and outsourcing war

Afghanistan, famously known as “the graveyard of empires”, has been a gravy train for the global private security industry for the past two decades, as the war was increasingly privatised and outsourced.

Under the Trump administration, private security companies with Pentagon contracts numbered nearly 6,000, costing US$2.3 billion (A$3.1 billion) in 2019. When the US military withdrawal began, these private contractors dropped to about 1,400 by July.

Until now, however, private security firms were such a critical element of the war effort that their departure was considered a key factor in the collapse of the Afghan army.

The appeal of these private security contractors lies in their arms-length advantage — they are relatively disposable and carry little political cost. This allows the industry to operate opaquely, with little oversight and even less accountability.

In the case of the Australian embassy guards, it would appear their direct employers have done little to secure their safety. How, then, can these companies and the governments that employ them be held accountable?

Little binding protection

The Montreux Document on Private Military and Security Companies – which reflects inter-governmental consensus that international law applies to private security companies in war zones – requires private security companies “to respect and ensure the welfare of their personnel”. Unfortunately, this is not a binding agreement.

The International Code of Conduct for Private Security Service Providers (ICoCA) – known as “the code” — lays out the responsibilities of private security under international law. It requires signatory companies to:

[…]provide a safe and healthy working environment, recognising the possible inherent dangers and limitations presented by the local environment [and to] ensure that reasonable precautions are taken to protect relevant staff in high-risk or life-threatening operations.

Australia is a signatory to the ICoCA, as are private security companies Gardaworld, Hart International Australia and Hart Security Limited, all of which operate in Afghanistan and have at various times been contracted by the Australian government.

But again, like the Montreux Document, the ICoC is non-binding. However, ICoC Executive Director Jamie Williamson has said:

The situation in Afghanistan is shining a spotlight on the duty of care clients of private security companies have towards local staff and their families […] We expect to see both our government and corporate members ensure the safety and well-being of all private security personnel working on government and other contracts, whatever their nationality.

Still no guarantee of safety

This duty of care now appears to have been extended to those guards who worked for the Australian and British governments in Afghanistan — albeit at the last minute. As one contractor told Australian media, he and his colleagues first applied for protection visas in 2012.

But their safety remains uncertain. The visas do not guarantee safe passage to Kabul’s international airport where evacuation efforts are chaotic. In the past weekend alone, 14 civilians were killed trying to flee the Taliban takeover.

There are also concerns about safe passage through Taliban checkpoints not being properly coordinated by US and NATO
allies, leaving dangerous alternative routes the only option.

Sheltering until they can safely travel to the airport is also fraught. As one guard explained:

Every day there is news that the Taliban will start a search for each house […] looking for people who have served the army and those who have served the foreign army.

Australia has made a legal and moral commitment to provide refuge to these people. But with the Taliban’s so-called red line of August 31 looming, the window to evacuate them and their families is closing.

And while the global private security companies may have shut up shop in Afghanistan for now, the consequences and human costs associated with outsourcing war linger on.The Conversation

Massive Muslim Mob Damages Church Building in Indonesia


Crowd of 1,000 celebrating eve of Islamic New Year ransack, set fire to construction site.

JAKARTA, Indonesia, December 23 (CDN) — Hundreds of Muslims celebrated the eve of the Islamic New Year last Thursday (Dec. 17) by attacking a Catholic church building under construction in Bekasi, West Java.

A crowd of approximately 1,000 men, women and children from the Bebalan and Taruma Jaha areas of Bekasi walking in a New Year’s Eve procession stopped at the 60 percent-completed Santo Albertus Catholic Church building, where many ransacked and set fires to it, church leaders said. Damage was said to be extensive, but no one was injured.

The crowd initially gathered at the Tiga Mojang Statue about a mile from the church between 10 and 10:45 p.m., said Kristina Maria Rentetana, head of the church building committee. She said there were no hints that the group would become a mob and attack the church building.

Rentetana said she joined the crowd as they walked along. Upon nearing the church, she said, they began throwing stones.

“They shouted, ‘Destroy it, destroy it,’” Rentetana told Compass. “Even women carrying babies joined in stone-throwing. Then a large group dressed in white robes entered the church, which was under construction, and started fires.”

The mob burned the security post and leveled a nearby contractor’s office. “They broke roof tiles, marble slabs, floor tiles, and lamps which had been placed in the building,” Rentetana said.

Some among the mob apparently had come prepared to burn the church building; an empty jerry can was found at the site. The mob also left a computer belonging to the contractor trampled in the gutter.

Rentetana immediately called police, and the mob finally dispersed around 12 midnight after at least 100 officers arrived.

Sector Police Chief Imam Sugianto said the attack on the church was spontaneous.

“There were agitators among the crowd as they walked,” Sugianto said. “These persons incited the crowd to burn the church.”

At press time police had arrested 12 people thought to be leaders of the mob.

“It is not clear whether these are all from the same organization or not,” Sugianto told Compass. Among those arrested was Amat Rosidi, accused of stealing a drill from the construction site.

A Santo Albertus Church priest identified only as Father Yos said the mayor of Bekasi had issued a valid building permit on Feb. 6, 2008. Bekasi is near Jakarta.

The priest said the church building was 60 percent complete on a plot of land of 2,261 square meters. He said he did not know the amount of losses.

Sugianto said he encouraged the church to proceed with plans for a Christmas Eve service and promised to provide adequate security.

“Please hold the Christmas Mass,” he said. “The police will guard the church.”

Rentetana confirmed that police had guaranteed security for the scheduled Christmas Mass.

Sugianto added that the attack on the church will be duly prosecuted, saying, “We will attempt to arrest all of the leaders of this action.”

Unprecedented Christmas Gathering Held in Vietnam


With permission little and late, organizers work by faith to accommodate crowds.

HO CHI MINH CITY, December 14 (CDN) — On Friday evening (Dec. 11), history was made in communist Vietnam.

Christian sources reported that some 40,000 people gathered in a hastily constructed venue in Ho Chi Minh City to worship God, celebrate Christmas, and hear a gospel message – an event of unprecedented magnitude in Vietnam.

A popular Vietnamese Christian website and other reports indicated up to 8,000 people responded to the gospel message indicating a desire to follow Christ.

For the last two years, authorities surprisingly granted permission to unregistered house churches in Ho Chi Minh City to hold public Christmas rallies, and last year more than 10,000 people participated in one in Tao Dan Stadium.

This year visionary house church leaders approached the government in October and asked for a sports stadium seating 30,000; they were refused. Authorities offered a sports venue holding only 3,000, located 13 kilometers (eight miles) out of the city. This was unacceptable to the organizers. They pressed for another stadium in the city holding about 15,000, and officials gave them a verbal promise that they could have it.

The verbal promise did not translate into the written permission that is critical in the country – church leaders say such promises are empty until “we have the permission paper in our hand.” Christian leaders believed event planning had to proceed without permission and sent out invitations far and wide – only to have authorities deny the stadium they had promised.

Led by Pastor Ho Tan Khoa, chairman of a large fellowship of house church organizations, organizers were forced to look for alternatives. They found a large open field in the Go Vap district of the city. When permission was still not granted five days before the planned event, several church leaders literally camped for three days outside city hall, pressing for an answer.

Authorities, who often work to sabotage united action among Christians, tried urgently to find ways to talk the leaders out of going ahead, promising future concessions if they would cancel the event. Organizers stood firm. Ultimately they told the deputy mayor that refusal to grant permission at that point would have far-ranging, negative ramifications in Vietnam as well as internationally.

Finally, at the close of business on Dec. 9, just 48 hours before the scheduled event, officials granted permission that required clearance all the way to Hanoi. But the permission was only for 3,000 people, and many more had been invited.

Organizers had less than two days to turn a vacant field into something that would accommodate a stadium-size crowd. They had to bring in ample electricity, construct a giant stage, rent 20,000 chairs, and set up the sound and lighting. The extremely short time frame caused contractors to double the prices they would have charged with ample time.

Organizers also rented hundreds of busses to bring Christians and their non-Christian friends from provinces near the city. Thousands of students sacrificed classes to help with last-minute preparations and to join the celebration.

Just after noon on Friday (Dec. 11), word came that police had stopped busses carrying 300 Steing minority people from the west to the event scheduled for that day. Organizers, fearing all busses would be stopped, put out an emergency worldwide prayer request.

Christian sources said that authorities either did not or could not stop busses from other directions, and that by evening the venue became the biggest “bus station” in all of Vietnam. By 6 p.m. the venue was full to capacity, and at least 2,000 had to be turned away.

Christians described the event, entitled, “With Our Whole Hearts,” in superlative terms. For house churches, large gatherings are both very rare and very special, and for many this was their first glimpse of the strength of Vietnam’s growing Christian movement. Thousands of Christians joined a choir of more 1,000 singers in loud and joyful praise.

Sources said that the main speaker, the Rev. Duong Thanh Lam, head of the Assemblies of God house churches “preached with anointing” and people responding to his gospel invitation poured to the front of the stage “like a waterfall.” With space in front of the stage insufficient, the sources said, many others in their seats also indicated their desire to receive Christ.

Organizers along with many participants were overwhelmed with emotion and gratitude as the event closed. People spontaneously hugged each other and cried, “Lord, bring revival to all of Vietnam!” Other comments included, “Beyond our fondest imagination,” and, “Nothing could stop the hand of the Lord.”

The event raised more than 60 million dong (US$3,280) for a charity helping needy children. People were quite surprised to read a positive article on the event in the state-controlled press, which often vilifies Christians.

House churches in the north were hopeful that they could hold a similar event. Organizers in Hanoi have heard encouraging reports that they will get permission to use the national My Dinh sports stadium for a Christmas celebration, though they do not have it in hand. Sources said they have sent out invitations across a broad area to an event scheduled for Dec. 20.

Friday’s event also made history in that it was streamed live on the Vietnamese website www.hoithanh.com and viewed by thousands more in Vietnam and by Vietnamese people around the world.

EGYPT: TWO COPTS RE-ARRESTED IN ABU FANA MURDER


Christians fear police coercing them to drop charges of Muslim attack on monastery.

ISTANBUL, May 29 (Compass Direct News) – Police this month released two Copts wrongfully arrested for killing a Muslim during an attack on Abu Fana monastery in Egypt in May 2008, but then re-arrested them as part of an intimidation campaign against Christians, their lawyer said.

More worrisome to the Christians in custody is that their fate most likely will be decided outside of the justice system, in “reconciliation meetings.” The state prosecutor investigating the case has not announced the results of his findings on the true identity of the murderer, as he is awaiting the outcome of the out-of-court talks between Copts and local Muslims.

Brothers Refaat and Ibrahim Fawzy Abdo have been incarcerated for a year. On May 3 the two brothers were released on bail, but the Minya State Security Services issued a new detention order and had them arrested on May 20 for “security reasons.” Egyptian security forces can incarcerate people without reason according to provisions in criminal law.

A criminal court in Cairo ordered the release of the Fawzy Abdo brothers twice, but each time the interior ministry issued another arrest order. Advocacy groups say the interior ministry is working with local police and the investigating officer to keep them detained, force a confession and make the Copts look guilty in the Abu Fana attack.

“Police arrested them for reasons of ‘security concerns’ in spite of no evidence,” said Ibrahim Habib, chairman of United Copts of Great Britain. “They are comforting Islamists by scapegoating Christians.”

The two men worked as building contractors on the walls of Abu Fana monastery in Upper Egypt when nearly 60 armed Muslim residents attacked it in May 2008. The attack left one Muslim dead and four Christians injured, and two of three monks briefly kidnapped were tortured.

Five days after the attacks, security forces arrested the Fawzy Abdo brothers, charging them with murder. In November they were sent to El Wadi El Gadid Detention Camp near the Egypt-Sudan border and tortured as authorities tried to extract a false confession of murder, their lawyer said.

Minya Gov. Ahmed Dia el-Din claimed the Muslim murdered at Abu Fana was killed by one of the brothers from 80 meters away. But the Coptic brothers’ lawyer, Zachary Kamal, told Compass that an autopsy showed a bullet fired from a short distance.

The two men have faced extreme conditions in prison such as solitary confinement and broken teeth from beatings, and they have not been allowed to see their families, who are undergoing extreme hardship. Refaat Fawzy Abdo has six children and Ibrahim Fawzy Abdo has seven; both Christians are the breadwinners of their households.

Reconciliation Instead of Justice?

Reconciliation meetings with area Muslims continue with the participation of Coptic businessmen, the diocese of Mallawi, a member of Parliament and attorney Kamal, all under the auspices of the police.

Such meetings are somewhat customary in Egypt, in which different parties come together to settle legal matters out of court. They carry a social purpose of restoring faith and communal harmony in the face of sectarian tensions.

Kamal said he was not opposed to a reconciliation meeting instead of normal judicial channels, but that terms of the discussion were unacceptable. Authorities want the brothers to admit to the murder of the Muslim and the Copts to pay compensation to the victim’s family.

“They want the Copts to accept guilt, but that means they will carry the blood of the victim the rest of their lives,” Kamal said.

Other Copts worry that the meetings are a substitute for administrative justice, and that police are using the brothers as a bargaining tool to force Abu Fana’s monks to drop charges against local Muslims and call off the investigation of the attack.

“The brothers are still held because they are being used as a negotiation chip,” said Samia Sidhom, English editor of Egyptian Christian weekly Watani. “The reconciliation efforts are to make the monks change their testimony. If they do that, the brothers will be released.”

Sidhom said that Coptic church leaders entered into negotiations with local Muslims and politicians and gave up their legal rights because obtaining justice in the Islamist-tilted Egyptian legal system is very difficult.

“Typically a Copt or their buildings are attacked, and the only way for the police to avoid punishing the culprits is through these reconciliation meetings, where the Copts give up any legal rights they have,” Sidhom said.

State officials, however, said the Copts are superimposing religious persecution claims onto a simple argument over property. The Minya governor said the attacks were not religious but were provoked by a long-standing land dispute between the monks and local Bedouins.

Whether the monastery attack started as a land dispute or not, the findings of secular rights groups revealed that in the course of the violence, attackers tied two of the kidnapped monks to a palm tree, whipped and beat them, and forced them to spit on a cross and give the confession of Islam, according to the Egyptian Initiative for Personal Rights.

Motives for the May 2008 attacks against the monastery, located 200 kilometers (124 miles) south of Cairo, are still unknown. Coptic advocacy groups claim the attacks were motivated by growing hostility against Egypt’s Christian community.
